Book excerpt: This article considers the future of the Antiquities Act in light of the controversy surrounding President Clinton's proclamation of a significant number of national monuments during his administration. The article considers whether the Act is likely to be amended by future administrations and concludes that amendment is unlikely given the increasing public preference for preservation and outdoor recreation. It notes, however, that even if the Act were repealed,its purposes could largely be accomplished by the withdrawal process in section 1714 of the Federal Land Policy Management Act (FFLPMA). The article also investigates whether presidents have the power to revoke or diminish existing national monuments. It concludes that the President lacks authority to revoke an existing monument but may have implied authority to diminish the size or protection of a national monument.
