Abstract: Abstract of thesis entitled The Actual and Potential Roles Played by Chinese NGOs in Human Rights Promotion and Protection in China Submitted by Tang Jie for the degree of Master of Philosophy at The University of Hong Kong in August 2005 Last decade has witnessed a stunning growth of non-governmental organizations (NGOs) in mainland China, covering economic, social, cultural, educational, scientific and legal areas, a phenomenon which has been said to be the emerging civil society in China. This non-state sector has been playing active roles to China's socioeconomic development. Internationally, NGOs have the nature ties with the global human rights movement. They contribute substantially to human rights advancement worldwide through all kinds of format, including standard setting, human rights education, legal and humanitarian aid, etc. This thesis attaches special attention to Chinese NGOs' contribution to the human rights situation in China. It first analyzes NGO's development trajectory in contemporary China and points out the major factors affecting NGO's growth. It then discusses existing NGO laws in China, attempting at analyzing the legislation deficiency and putting forward the suggestions for improvement. Through several detailed case studies, this paper figures out the legal and political environments facing by nascent Chinese non-state entities. It argues although compared with the international NGOs, Chinese human rights non-state activists are still on their infancy stage, they could play the leading role to promote human rights causes in China in the coming years. By examining the specific NGO examples working in the human rights field, this study reviews the strategies employed and the challenges encountered by these non-state actors within their human rights efforts. The future prospect for NGOs human rights work in China is also presented in the thesis. Through a comparative analysis of nongovernmental organizations (NGOs) in today’s China, this study shows the importance of the human factor, notably the NGO leadership, in the establishment of a modern civil society. In particular, in recognition of the social nature of NGOs, this study engages in a comparative examination of Chinese NGO leaders’ state linkage, media connections and international ties in order to better understand how each factor contributes to effective NGOs.

Eva Pils offers a nuanced account of this contentious area, examining human rights as a set of social practices. Drawing on a wide range of resources including years of interaction with Chinese human rights defenders, Pils discusses what gives rise to systematic human rights violations, what institutional avenues of protection are available, and how social practices of human rights defence have evolved. Three central areas are addressed: liberty and integrity of the person; freedom of thought and expression; and inequality and socio-economic rights. Pils argues that the Party-State system is inherently opposed to human rights principles in all these areas, and that – contributing to a global trend – it is becoming more repressive. Yet, despite authoritarianism's lengthening shadows, China’s human rights movement has so far proved resourceful and resilient. The trajectories discussed here will continue to shape the struggle for human rights in China and beyond its borders.

The reform plans of the Chinese government have caused a great echo abroad, since the new law will have a significant impact on the activities of foreign NGOs in mainland China. In future, they will have to choose between two forms of activities, either to establish a representative office or to carry out temporary activities. However, both cases require a registration process with the authorities of Public Security as part of the new comprehensive monitoring and controlling system. At first, the article illuminates the historical and political background of foreign NGOs and their activities in China. Then, a brief overview of the current legal framework, under which foreign NGOs in China are entitled to act, is given. The focus lies on the analysis of the new legislation, in particular, the registration procedure for both forms of activities, followed by a closer view on special provisions to be observed after a successful registration, and a discussion of the regulatory powers in case of a violation of the legal provisions.
