Book excerpt: A suit for the recovery of a slave and his hire. Banks purchased the slave in 1848 on credit, and gave Taylor as his security. In 1851 the slave came into the possession of Taylor, and stayed with him until he was seized by the sheriff under a fieri facias against Smith in 1858. At the sale the slave was bought by Taylor as the property of Smith, and Taylor claimed a privilege on the proceeds of the sale over the seizing creditors of Smith. The lower court found that Taylor's purchase of the slave at the execution was inconsistent with any previous claims of ownership on his part, and that the slave had been the property of Smith. The Supreme Court reversed this judgment, awarding Taylor [dollars] 741.80 as the balance on the promissory notes given for the slave, and that this judgment be enforced against Smith.

Book excerpt: An appeal by the defendants, Smith and Taylor, against the judgment of the District Court decreeing the freedom of the plaintiff, Lucy Brown and her two children. Born into slavery, the plaintiff was indentured to Elijah Mix until she reached the age of 21, when it was agreed that she would be emancipated. The indenture was signed by the plaintiff, her father and Elijah and was witnessed by Samuel Cooper, an officer in the US army. The plaintiff also had a certificate of emancipation, signed by Elijah and dated in 1823, which she entrusted to her attorney in 1849 but which had since been misplaced. Whilst in the service of Elijah Mix, the plaintiff resided in New York with him and his family in the years 1823-1825. In 1825 Elijah moved back to Georgetown until 1829, when he returned to New York. During this time, the plaintiff moved and lived with Elijah Mix and his family until 1832 when he sold the plaintiff to Captain Wells who later sold her to Taylor who then sold her to Smith, where she came to reside in New Orleans. However, as the plaintiff had resided in New York, her right to freedom had been established according to the New York nine-month law which decreed that a slave brought into the State could reside as a slave in the State for nine months, beyond which time the slave would be free. The defendants contested the plaintiff's suit for freedom asserting that she lost her free status when she moved back to Georgetown in the years 1825-1829. The Supreme Court maintained the legitimacy of the plaintiff's freedom under the New York Law and recognised her certificate of emancipation. Judgment was affirmed and the plaintiff was awarded [dollars] 5 a month in wages from the date of her suit to the date of judgment. The defendants applied for a re-hearing; the application was denied.
