Yet there has been little historical research into the policing, prosecution and punishment of those crimes. This book examines Australia’s treatment of sexual crimes in the 1950s, a decade well known for its political and social conservatism, its prudish views on morality, and its prescriptive gender roles for men and women. Fewer would know that this same decade saw soaring arrests, mounting criminal prosecutions, and intensifying public debates about how to deal with sexual offenders. Or that sexual offences on children attracted the most concentrated state attention and public concern. Sex Crimes in the Fifties uncovers this new history by drawing on transcripts of hundreds of criminal proceedings and extensive research in criminal justice archives. We examine the criminal trial itself, exploring how prosecutors, defence counsel, witnesses, juries and judges understood sexual crimes. We consider the experience of women testifying in rape trials, the prosecution of sexual crimes against children, the court’s treatment of recent immigrants, the prosecution and punishment of homosexual men, the influence of psychiatric evidence, and the increasing public debates over the ‘sex offender’. We show that the 1950s was indeed foundational to many of our contemporary beliefs about sexual crimes. This book makes a major contribution to our historical and socio-legal knowledge about sexual offences and criminal prosecution. It will be of interest to historians, criminologists, sociologists, and legal scholars as well as general readers interested in the treatment of these crimes in our past.

As part of a broader interest in individualised responses to crime as a means to rehabilitation, doctors offered new explanations for some sexual crimes, proposed new solutions, and attempted to deliver new cures. From indecent exposure to homosexuality between men, from sadistic violence to thefts of underwear from washing lines, the interpretation and treatment of some sexual offences was thought to be complex. Of less medical interest, though, were offences against children, prostitution, and rape. Using a range of material, including medical and criminological texts, trial proceedings, government reports, newspapers, and autobiographies and memoirs, Janet Weston offers powerful insights into changing medico-legal practices and attitudes towards sex and health. She highlights the importance of prison doctors and rehabilitative programmes within prisons, psychoanalytically-minded private practitioners, and the interactions between medical and legal systems as medical theories were put into practice. She also reveals the extent and legacy of medical thought, as well as the limitations of a medical approach to sexual crime.

On an atternoon in Sept- ber 1988, Dorothy and Roy Porter, and I, sketched out a plan for a set of conf- ences in which scholars from a variety of disciplines would explore the emergence of modern medical ethics in the English-speaking world: from its pre-history in the quarrels that arose as gentlemanly codes of etiquette and honor broke down under the pressure of the eighteenth-century "sick trade," to the Enlightenment ethics of John Gregory and Thomas Percival, to the American appropriation process that culminated in the American Medical Association's 1847 Code of Ethics, and to the British turn to medical jurisprudence in the 1858 Medical Act. Roy Porter formally presented our idea as a plan for two back-to-back c- ferences to the Wellcome Trust, and I presented it to the editors of the PHI- LOSOPHY AND MEDICINE series, H. Tristram Engeihardt, Jr. and Stuart Spicker. The reception from both parties was enthusiastic and so, with the financial backing of the former and a commitment to publication from the latter, Roy Porter, ably assisted by Frieda Hauser and Steven Emberton, - ganized two conferences. The first was held at the Wellcome Institute in - cember 1989; the second was sponsored by the Wellcome, but was actually held in the National Hospital, in December 1990.

Beginning his history in the medieval period, Edward Higgs reveals how it was not the Industrial Revolution that brought the most radical changes in identification techniques, as many have assumed, but rather the changing nature of the State and commerce, and their relationship with citizens and customers. In the twentieth century the very different historical techniques have converged on the holding of information on databases, and increasingly on biometrics, and the multiplication of these external databases outside the control of individuals has continued to undermine personal identity security.
