This is the third regular pleading in consecutive order, or the second regular pleading of plaintiff, and if he does not demur it is his only alternative if he answers at all. As traverse, confession and avoidance, and estoppel have already been discussed, nothing remains to be said except as to "a new assignment" and "traverse de injuria," for in other respects the replication is similar to the pleas above mentioned. These are peculiar to the pleadings at this stage and are never found except in a replication, as a dilatory plea and general issue are never found except in the plea. If defendant's plea missed the mark set him by plaintiff because of the indefiniteness of the declaration, and was addressed to facts other than those on which plaintiff relied and which he intended as his cause of action, in stead of taking the ordinary steps in pleading plaintiff would find it necessary to restate his cause of action in the replication by employing more certain terms or a more definite allegation of the facts relied on, and thus set the defendant right and permit him to rejoin thereto according to the corrected form and real meaning. For example: If plaintiff had suffered two assaults, one of which was justified, but he did not sufliciently distinguish between them, so that defendant pleaded in justification of the one, it would be necessary for plaintiff to exclude the one not relied on by a new assignment. If defendant partially understood the declaration and answered to a portion of the cause intended, plaintiff could admit, or traverse, or probably confess, and avoid the plea to that extent, and...
