EDITOR'S PREFACE The purpose of this book is to provide a fairly broad survey of the Swedish legal system. In order to avoid possible disappointment, it would seem important to make clear from the outset what kind of questions the authors propose to answer and what groups of readers they are addressing. The easiest way to do this is to set out what we are not purporting to do. Thus, the book is not intended to serve as a primer for students who possess no knowledge of "the law", i. e. of the concepts, ideas and solutions of at least one legal system. Nor is it the purpose of the authors to give practitioners the kind of precise, techni cal answers to isolated questions that they need when advising their clients on the proper course of action in business, or litigation, con ducted within the framework of the legal system described.

Book Legal Assistance to Developing Countries

Download or read book Legal Assistance to Developing Countries written by Sevastik and published by Martinus Nijhoff Publishers. This book was released on 2023-09-20 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the early 1960s an essential ingredient of Sweden's international development aid has been focused on democracy and human rights issues and Sweden has been refining its policy continuously within this area. Today this policy has reached a certain degree of sophistication and therefore a natural focal point is on the development of the rule of law in various recipient countries. When and why was it introduced in Swedish development assistance? What does it actually entail? These and other issues related to assistance within the legal sector are discussed in this anthology written by university professors, researchers and lecturers from various law faculties and institutions in Sweden familiar with the developmental work which is channelled through the Swedish International Development Co-operation Agency (SIDA). It encapsulates both actual conditions and ideas outlining future perspectives.

Book Deference to the Administration in Judicial Review

Download or read book Deference to the Administration in Judicial Review written by Guobin Zhu and published by Springer Nature. This book was released on 2019-11-23 with total page 445 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book investigates judicial deference to the administration in judicial review, a concept and legal practice that can be found to a greater or lesser degree in every constitutional system. In each system, deference functions differently, because the positioning of the judiciary with regard to the separation of powers, the role of the courts as a mechanism of checks and balances, and the scope of judicial review differ. In addition, the way deference works within the constitutional system itself is complex, multi-faceted and often covert. Although judicial deference to the administration is a topical theme in comparative administrative law, a general examination of national systems is still lacking. As such, a theoretical and empirical review is called for. Accordingly, this book presents national reports from 15 jurisdictions, ranging from Argentina, Canada and the US, to the EU. Constituting the outcome of the 20th General Congress of the International Academy of Comparative Law, held in Fukuoka, Japan in July 2018, it offers a valuable and unique resource for the study of comparative administrative law.

Book excerpt: Governments in Western Europe, Government in Sweden: The Executive at Work focuses on the affairs of the Swedish government. The book first offers information on the structure and constitutional reforms instituted in the government of Sweden. This information includes the function of the monarchy, council of state, and departments and boards in running the affairs of the government. The text also expounds on the volume of citizens involved in state service, and also the legislative process of the country. The selection also examines the internal and judicial controls on the executive branch of the government. The liability of civil servants for their actions; creation of specialized agencies for internal finance and efficiency control; and administrative appeals are elaborated. Discussions also focus on the external controls of the executive branch. Consideration includes the publicity of official documents; inspection of the minutes of the council; parliamentary auditors and ombudsmen; and interpellations and questions. The text is a vital reference for readers interested in the governments of Western Europe, particularly the government of Sweden.
