Book excerpt: This paper analyzes land transactions between municipalities and private businesses based on official data and business surveys in 15 regions of the Russian Federation. Since the Russian Federation passed the new Land Code in 2001, land privatization has been officially encouraged by the federal government and in particular, land under previously privatized buildings was supposed to be privatized to the owner at a nominal price. The paper shows that many subnational authorities (which own or control the vast majority of land of interest to businesses) appear to use a combination of high statutory land buy-out prices and administrative barriers to deter land privatization and to offer "long-term leases" (which are not fully marketable) instead. On the other hand, regions that have established low buy-out prices and taken steps to remove unnecessary administrative barriers to land privatization appear to have higher rates of land ownership by businesses, and to face lower levels of corruption in the privatization process. The paper concludes that further reductions in the statutory prices for privatization of land under buildings and elimination of unnecessary administrative barriers should help to encourage further land privatization and the development of a competitive, secondary market in commercial land.

To understand this failure, Stephen Wegren examines contemporary land reform policies in terms of legislation, institutional structure, and human behavior. Using extensive survey data, he analyzes household behaviors in regard to land ownership and usage based on socioeconomic status, family size, demographic distribution, and regional differences. Wegren's study is important and timely, as Russian land reform will have a profound effect on Russia's ability to compete in an era of globalization.

Book excerpt: This special issue of the REVIEW OF CENTRAL AND EAST EUROPEAN LAW compiles the material published under the head `Russian Federation Legislative Survey' in the six 1993 issues of the journal. It covers Russian legislation from the date of the Declaration of the State of Sovereignty of the RSFSR (12 June 1990) until the end of 1992. The principal watershed in this period was the disappearance of the USSR. This event had far-reaching consequences for Russian law, because of the two-tier character of law in the former Soviet Union: USSR law at the top, and underneath the subordinate legal systems of the individual union republics, including the RSFSR. These consequences can still be felt in many areas, and it will take considerable time and major efforts to replace all USSR law by new Russian enactments. The Institute of East European Law and Russian Studies intends to bring this survey up to date as soon as possible. This is of course desirable for the practitioner, as well as for the academic user. It is felt, however, that it was imperative to build on a solid foundation, even if it meant some delay in the beginning. As new official sources of legislation emerge, as some already have in 1993, they will be included in the issues of the REVIEW OF CENTRAL AND EAST EUROPEAN LAW. The present survey is a reprint of the fourth issue of the REVIEW OF CENTRAL AND EAST EUROPEAN LAW (1994) and is available gratis to subscribers.
