Book Secret State

Download or read book Secret State written by Julian Grill and published by . This book was released on 2022 with total page 614 pages. Available in PDF, EPUB and Kindle. Book excerpt: Julian's book, Secret State, was researched and written over almost a decade. It details the strenuous and doubtfully legitimate program waged by WA's Corruption and Crime Commission against him and former WA Premier Brian Burke. The CCC campaign was largely based on covet surveillance, including phone taps, hidden recording devices and cameras, secret grossly unfair inquisitions - and public hearings that were used to create media stories and damage witnesses' credibility. The decade-long CCC operation occasioned a media storm across Australia, but was ultimately fruitless. However, the over hyped vendetta created extensive personal and reputational damage to Julian and Brian, and their families, friends and associates - including a host of blameless senior public servants who had routine or incidental contacts with the two CCC targets. Secret State sets the record straight. Julian's attention to accuracy and detail, and his entertaining literary style, make it a significant contribution to WA's legal and social history in the early decades of the 21st Century. After graduating from the University of Western Australia, Julian Grill practised as a barrister and solicitor in WA's Goldfields region, involved intensively in criminal defence and mining law. In 1977, representing the Australian Labor Party, he was elected to the WA Legislative Assembly. During his 24 years in Parliament he held many ministerial portfolios. After retiring from Parliament in 2001, Julian served as the chairman and non-executive director of several publicly listed companies. He also established Julian Grill Consulting, providing legal, strategic and government relations advice to an extensive list of corporate clients.

Download or read book Damages and Human Rights written by Jason NE Varuhas and published by Bloomsbury Publishing. This book was released on 2016-05-19 with total page 547 pages. Available in PDF, EPUB and Kindle. Book excerpt: Winner of the 2018 Inner Temple New Authors Book Prize and the 2016 SLS Peter Birks Prize for Outstanding Legal Scholarship. Damages and Human Rights is a major work on awards of damages for violations of human rights that will be of compelling interest to practitioners, judges and academics alike. Damages for breaches of human rights is emerging as an important and practically significant field of law, yet the rules and principles governing such awards and their theoretical foundations remain underexplored, while courts continue to struggle to articulate a coherent law of human rights damages. The book's focus is English law, but it draws heavily on comparative material from a range of common law jurisdictions, as well as the jurisprudence of international courts. The current law on when damages can be obtained and how they are assessed is set out in detail and analysed comprehensively. The theoretical foundations of human rights damages are examined with a view to enhancing our understanding of the remedy and resolving the currently troubled state of human rights damages jurisprudence. The book argues that in awarding damages in human rights cases the courts should adopt a vindicatory approach, modelled on those rules and principles applied in tort cases when basic rights are violated. Other approaches are considered in detail, including the current 'mirror' approach which ties the domestic approach to damages to the European Court of Human Rights' approach to monetary compensation; an interest-balancing approach where the damages are dependent on a judicial balancing of individual and public interests; and approaches drawn from the law of state liability in EU law and United States constitutional law. The analysis has important implications for our understanding of fundamental issues including the interrelationship between public law and private law, the theoretical and conceptual foundations of human rights law and the law of torts, the nature and functions of the damages remedy, the connection between rights and remedies, the intersection of domestic and international law, and the impact of damages liability on public funds and public administration. The book was the winner of the 2016 SLS Peter Birks Prize for Outstanding Legal Scholarship and the 2018 Inner Temple New Authors Book Prize.

Book The Statutory Foundations of Negligence

Download or read book The Statutory Foundations of Negligence written by Mark Leeming and published by . This book was released on 2019-01-21 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work explains how statutes underpin and inform the whole of the law of negligence. Although the civil liability legislation has highlighted the foundational role of statutes, in truth this has been the case for many decades. The book shows how throughout the entirety of the law of negligence - including duty, breach, causation, contributory negligence, statutory contribution, proportionate liability and damages - statutes have been responsible for the law as it is now understood and practised. In particular, the law of causation, of damages for mental harm and the immunity of highway authorities are shown to have been deeply informed by statute. Moreover, the contribution of statutes is demonstrated to be vital, complex and interesting. The book's purpose is both educational and practical. While it will strengthen the reader's conceptual understanding of the complex ways in which statutes and the common law interact to produce the law of negligence, the book is far from a work of abstract theory. On the contrary, its focus is on the very significant practical consequences that flow from the interaction. As such, it will be of enormous assistance to any practitioner seeking to understand or practise in the area. The coverage is Australia-wide.

Download or read book The Law of Misstatements written by Kit Barker and published by Bloomsbury Publishing. This book was released on 2015-08-27 with total page 622 pages. Available in PDF, EPUB and Kindle. Book excerpt: 2013 was the 50th anniversary of the House of Lords' landmark decision in Hedley Byrne v Heller. This international collection of essays brings together leading experts from five of the most important jurisdictions in which the case has been received (the United Kingdom, the United States, New Zealand, Canada and Australia) to reappraise its implications from a number of complementary perspectives-historical, theoretical, conceptual, doctrinal and comparative. It explores modern developments in the law of misstatement in each of the jurisdictions; examines the case's profound effects on the conceptual apparatus of the law of negligence more generally; explores the intersections between misstatement liabilities in contract, tort, equity and under statutory consumer protection provisions; and critically assesses the ways in which advisor liabilities have come to be limited and distributed under systems of 'joint and several' and 'proportionate' liability respectively. Inspired by Hedley Byrne, the purpose of the collection is to reflect on the case's echoes, effects and analogues throughout the private law and to provide a platform for thinking about the ways in which liabilities for misstatement and pure economic loss should be modelled in the modern day.
