Book excerpt: Francisco Suárez was a principal figure in the transition from scholastic to modern natural law, summing up a long and rich tradition and providing much material both for adoption and controversy in the seventeenth century and beyond. Most of the selections translated in this volume are from On the Laws and God the Law-Giver (De legibus ac Deo legislatore, 1612), a work that is considered one of Suárez’s greatest achievements. Working within the framework originally elaborated by Thomas Aquinas, Suárez treated humanity as the subject of four different laws, which together guide human beings toward the ends of which they are capable. Suárez achieved a double objective in his systematic account of moral activity. First, he examined and synthesized the entire scholastic heritage of thinking on this topic, identifying the key issues of debate and the key authors who had formulated the different positions most incisively. Second, he went beyond this heritage of authorities to present a new account of human moral action and its relationship to the law. Treading a fine line between those to whom moral directives are purely a matter of reason and those to whom they are purely a matter of a commanding will, Suárez attempted to show how both human reason and the command of the lawgiver dictate the moral space of human action. The Liberty Fund edition is a revised version of that prepared for the Carnegie Endowment for International Peace by translators Gwladys L. The work shares with Ivan Illich's In the Vineyard of the Text the conviction that the rise of the Schools (Paris, Oxford, etc.) constitutes one of the greatest intellectual watersheds in the history of Western civilization: where Illich's ruminations are largely philosophical and particularly epistemological, the author's are theological and metaphysical. In his novel proposal that within the monastic and scholastic milieux there obtain parallel threefold analogies among friendship, reading, and theology, the author not only offers an original contribution to current scholarship, but gestures towards avenues for institutional self-examination much needed by the contemporary--modern and postmodern--Academy.

Book excerpt: CATHOLIC PERSPECTIVES AND CONTEMPORARY MEDICAL MORALS A Catholic perspective on medical morals antedates the current world wide interest in medical and biomedical ethics by many centuries[5]. Discussions about the moral status of the fetus, abortion, contraception, and sterilization can be found in the writings of the Fathers and Doctors of the Church. Teachings on various aspects of medical morals were scattered throughout the penitential books of the early medieval church and later in more formal treatises when moral theology became recog nized as a distinct discipline. Still later, medical morality was incorpor ated into the many pastoral works on medicine. Finally, in the contemporary period, works that strictly focus on medical ethics are produced by Catholic moral theologians who have special interests in matters medical. Moreover, this long tradition of teaching has been put into practice in the medical moral directives governing the operation of hospitals under Catholic sponsorship. Catholic hospitals were monitored by Ethics Committees long before such committees were recommended by the New Jersey Court in the Karen Ann Quinlan case or by the President's Commission in 1983 ([8, 9]). Underlying the Catholic moral tradition was the use of the casuistic method, which since the 17th and 18th centuries was employed by Catholic moralists to study and resolve concrete clinical ethical dilem mas. The history of casuistry is of renewed interest today when the case method has become so widely used in the current revival of interest in medical ethics[ll].
