Book Statute Rolls of the Irish Parliament

Download or read book Statute Rolls of the Irish Parliament written by Ireland. Parliament (1297-1800) and published by Four Courts Press. This book was released on 2002 with total page 426 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the fifth and final volume in the series of early statutes begun by the Public Record Office of Ireland in 1907. It contains the text, with English translation, of the statute rolls of the parliaments held in Ireland in 1484, 1485 and 1493, and the complete English text of the statute roll of Henry VIII's Reformation Parliament of 1536-7, the only such roll to survive the Four Courts fire in 1922. Several unpublished acts of the reign of Edward IV (1461-83) are also included. The earlier acts show the changes in the Irish political establishment from the supremacy of the earl of Kildare under the Yorkist kings to the Tudor reaction under Henry VII. The enactments of the Reformation Parliament include Henry VIII's assumption of the supreme headship of the church in Ireland and the consequent setting up of new administrative procedures, the beginning of the process of dissolving the monasteries, and provisions for the succession to the throne on the king's death. This edition will be of use to those working in the fields of medieval and early modern Irish history and to constitutional, ecclesiastical and legal historians.

This book was released on 2013-07-28 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection is the first to concentrate attention on the actual relationship that existed between the Irish population and the state under which they lived from the War of the Two Kings (1689–1691) and the Great Famine (1845–1849). Particular attention is paid to an understanding of the legal character of the state and the reach of the rule of law, addressing such themes as how law was made and put into effect; how ordinary people experienced the law and social regulations; and how Catholics related to the legal institutions of the Protestant confessional state. These themes will help to situate the study of Irish society into the mainstream of English and European social history.

Book National Constitutions in European and Global Governance Democracy Rights the Rule of Law

Download or read book National Constitutions in European and Global Governance Democracy Rights the Rule of Law written by Anneli Albi and published by Springer. This book was released on 2019-05-29 with total page 1522 pages. Available in PDF, EPUB and Kindle. Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.

Book The Laws and Other Legalities of Ireland 1689 1850

Download or read book The Laws and Other Legalities of Ireland 1689 1850 written by Seán Patrick Donlan and published by Routledge. This book was released on 2016-03-03 with total page 409 pages. Available in PDF, EPUB and Kindle. Book excerpt: While Irish historical writing has long been in thrall to the perceived sectarian character of the legal system, this collection is the first to concentrate attention on the actual relationship that existed between the Irish population and the state under which they lived from the War of the Two Kings (1689-1691) to the Great Famine (1845-1849). Particular attention is paid to an understanding of the legal character of the state and the reach of the rule of law, with contributors addressing such themes as: how law was made and put into effect; how ordinary people experienced the law and social regulations; how Catholics related to the legal institutions of the Protestant confessional state; and how popular notions of legitimacy were developed. These themes contribute to a wider understanding of the nature of the state in the long eighteenth century and will therefore help to situate the study of Irish society into the mainstream of English and European social history.
