The power is vested in the legislatures of the several States to make, ordain and establish all manner of laws, statutes and ordinances not repugnant to the Constitution and deemed for the best good and interest of the Common wealth. It is by and through these law making bodies women must establish their protective and defensive measures and these measures should be so fair, sane and equitable as to command universal respect and confidence. Careful and intelligent progress by women in the shaping of such new laws as are intended to equalize their status with the male citizen will best demonstrate their right to citizenship with its resultant obligations and duties, for in the multiplicity of laws now cluttering our statute books a few more, unless direct, forceful and valid, will but add to the confusion and defeat their purpose. It may be well to recall the fact that in 1913 more than two thousand bills were introduced in the Wisconsin legislature, of which eight hundred and twenty three were passed. The law making bodies of other States stagger, session after session, under equally heavy burdens. Wherefore it would seem that a Bureau of Legislation, with women fairly represented, to which all bills would have to be submitted for approval before introduction. Book excerpt: Excerpt from American Statute Law: An Analytical and Compared Digest of the Constitutions and Civil Public Statutes of All the States and Territories Relating to Persons and Property in Force January 1, 1886 Upon examination, however, the author found that the bulk of these voluminous laws was, after all, identical in the several states. He found that one main stream of legislation could be traced, occasionally comprehending all the Northern, Eastern, and N orth-western states, more often divided into two main bodies, the one following in its legislation the general model of the State of New York, the other that of the New Eng land states. He found, besides this, another important group, containing the South Western states, under the general lead of Maryland and Virginia and still a third and smaller group, comprising the gulf states. Besides these three main groups, there was one state with laws wholly anomalous (louisiana), and others (like California, Dakota, New Mexico, and Georgia) with laws peculiar to a greater or less extent. Here at once it became evident that, by a process of citing the respective laws once for all, with a list of all the states enacting them, and without repetitions, the work might be reduced by nine tenths or more of its first apparent size. But, furthermore, it will readily be seen that many of the statutes in all states are of purely local interest or special application. For instance, the law of the laying out of roads, of the manner of assessing taxes, and the laws creating special corporations, municipal or otherwise, or special kinds of corporations, can rarely be wanted by a lawyer outside of the state where such statute or corporation exists; and as every one is presumed to have the statutes of his own state at hand, it would obviously neither be possible nor profitable to collate statutes of this description. And of course all private acts and local or special laws may be wisely omitted. Perhaps one half of the bulk of the statutes was taken away by these exceptions. And, finally, for the purposes of the present edition, the author has not deemed it advisable to collate the statutes of criminal law, nor many statutes of civil procedure, such as no one will be likely to want unless he is actually conducting a case in court out of his own state. These objects and the great changes since 1898, the date of the last Revision, in the questions which have occupied the courts, have required the extension of the work to three volumes. The titles of both State and Federal cases have for the first time been inserted, as well as the volumes of the different series of reports other than those of the official series. Titles of a statutory and changing nature have been treated less fully, so as to avoid purely ephemeral matter. Judge Baldwin (modern Political Institutions 241) quotes Jeremiah Mason as saying that the development of an American Jurisprudence can only be looked for from the courts of the National Government. The Editor has been guided by that thought and sees in it a hope of increasing uniformity of law, towards which the profession, in its work on uniform legislation, is making real progress. He has therefore constantly cited the decisions of the Supreme Court of the United States and very frequently those of the lower Federal Courts. Of course, on many of the questions now being passed upon by the State Courts, the decisions of the Supreme Court are of binding authority.
