Download or read book The Governance of Credit Rating Agencies written by Andrea Miglionico and published by Edward Elgar Publishing. This book was released on with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: The global crisis revealed that credit rating agencies (CRAs) are capable of bringing about potential distortions in the financial sector, thereby resulting in a reduction in market confidence which, in turn, influences negotiations and expectations. CRAs need to be held accountable for lack of transparency and inaccurate ratings, however the existing regulatory framework does not secure adequate investor protection. This book provides a new and important contribution to research in the area, at a crucial time in the debate around financial regulation and investment regimes.

Download or read book Vanishing Contract Law written by Catherine Mitchell and published by Cambridge University Press. This book was released on 2022-09-01 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: English contract law provides the invisible framework that underpins and enables much contracting activity in society, yet the role of the law in policing many of our contracts now approaches vanishing point. The methods by which contracts come into existence, and notionally create binding obligations, have transformed over the past forty years. Consumers now enter into contracts through remote and automated processes on standard terms over which they have little control. This book explores the substantive weakening of the institution of contract law in a society heavily dependent on contracts. It considers significant areas of contracting activity that affect many people, but that escape serious and sustained legal scrutiny. An accessibly written and succinct account of contract law's past, present and future, it assesses the implications of a diminished contract law, and the possibilities, if any, for its revival.
Download or read book EU Investor Protection Regulation and Liability for Investment Losses written by Marnix Wallinga and published by Springer Nature. This book was released on 2020-10-30 with total page 440 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the relationship between the EU investor protection regulations enshrined in MiFID and MiFID II and national contract and torts law. It describes how the effect of the conduct of business rules as implemented in national financial supervision legislation in private law extends to the issue of enforcement, and critically assesses this interaction from the perspective of EU law. In particular, the conclusions identified in the book will deepen readers’ understanding of the interplay between the conduct of business rules and private law norms governing a firm’s liability to pay damages, such as duty of care, attributability of damage, causation, contributory negligence and limitation. In turn, the book identifies the subordination and the complementarity model to conceptualise the interaction between the conduct of business rules and private law norms. Moreover, the book challenges the view that civil courts are – or should be – forced to give private law effects to violation of the MiFID and MiFID II conduct of business rules in line with the subordination model. Instead, the complementarity model is advanced as the preferred approach to this interaction in view of what MiFID and MiFID II require from Member States in terms of their implementation, as well as the desirability of each model. This model presupposes that courts should consider the conduct of business rules when adjudicating individual disputes, while preserving the autonomy of private law norms governing liability of investment firms towards clients. Based on analysis of case law of courts in Germany, the Netherlands and England & Wales, as well as scholarly literature, the book also compares the available causes of action, the conditions of liability and the obstacles investors face when claiming damages, as well as how and the extent to which investors can benefit from the conduct of business rules in clearing these obstacles. In so doing, under the approach adopted by national courts to the interplay between the conduct of business rules of EU origin and private law, the book shows how investors can benefit from the influence of these rules on private law norms. In closing, it demonstrates a hybridisation of private law remedies resulting from the accommodation of the conduct of business rules into the private law discourse according to the complementarity model, illustrating how judicial enforcement through private law means may contribute to investor protection.

Download or read book London written by Dan Ryan and published by Author House. This book was released on 2011-10-03 with total page 468 pages. Available in PDF, EPUB and Kindle. Book excerpt: LONDON is the continuation of the story begun in WAR OF THE NATIONS. It is a work of fiction. The names, characters, places and incidents portrayed in this novel are the product of the authors imagination or have been used fictitiously. The characters are placed within the historical perspective of the signing of the Armistice on November 11, 1918 and the years immediately following this event. The events depicted in this novel were first presented in the Times Encyclopedia and Gazetter, 431 South Dearborn Street, Chicago, Illinois, copyrighted 1934. This collection of eight volumes contains a comprehensive, day by day narrative of the world war and years immediately following. The main characters are Admiral James Caldwell and his two sons, James Jr. and Louis Caldwell. James Sr. is the story teller as the navy family considers moving to London following the war. The purchase of 1600 acres called Springwell in the novel is based upon the purchase of Chartwell by Winston Churchill in 1921. Winston Churchill faced a similar situation in his life at this time in history. Churchill entered the British army in 1893, fought at the battle of Khartoum with the Nile Expeditionary Forces in 1898 and was in the Boer War of 1899. He was elected to parliament for Oldham in 1900, was Under-secretary of State for the Colonies in 1906, married Clementine Hozier in 1908 and was Home Secretary in 1910. He served as First Lord of the Admiralty, Minister of Munitions and Secretary for War and Air during the war. In 1921 he was voted out of office and the House of Commons. The novel is a work of fiction. Its location was inspired by my time spent in London during the spring semester of 1974. The Rotary Foundation Group Exchange, district 114 in England invited a number of scholars from the United States to spend time in England living with various Rotarians of District 114. I was teaching at the University of Nebraska at the time, and I was chosen to represent District 565 of the United States. It was during this time that I came to know the people of Reigate, Redhill and Merstham, just south of London. This is where I met some of the characters for my novel and I stayed overnight in the Prince of Wales in Reigate, the Ashleigh Public House in Redhill and the Lakers Hotel in Merstham. The historical events which are outlined in this book all took place. The dates and locations are accurate, but the characters are the products of my overactive imagination. Some persons mentioned, however, are real. You cannot write about this period of our history without making reference to commanding admirals or generals.
Download or read book Dinosaur Bones written by Michael Burke and published by Parlor Press LLC. This book was released on 2020-08-18 with total page 101 pages. Available in PDF, EPUB and Kindle. Book excerpt: Dinosaur Bones collects poems written by Michael Burke over his career as an acclaimed visual artist. Many of these poems tell a story. “I Made A List” travels from Mabel’s breast to a 10,000-foot-high observatory In Hawaii, to the deepest point in the ocean. A love poem begins on Ninth Avenue and ends in a St. Petersburg concert hall during the summer solstice. Others can be light-hearted and humorous, such as “Caterpillars Don’t Write Poems,” “Beetles Beware,” and “Sex Is Silly.” Others are profoundly speculative. Burke’s background as an astronomer often comes into play with poems that link everyday thoughts with Einstein’s theories or quantum mechanics. Burke says of his poems, “I draw landscapes, vanishing points shift, consistent with the probabilities that remain of our once precise science.” Dinosaur Bones invites readers to share the trials, successes, and humor of a widely varied life. The collection is illustrated with Burke’s own drawings.
