This research presents how: Trafficking is a profitable and popularindustry; Pennsylvania is a source, destination, and pass-through trafficking state; legislation and law enforcement are affecting the industry; the internet provides a platform which allows sex trafficking to flourish; and Backpage.com was a classified advertisement website known for facilitating sex trafficking. This research addresses the following questions: (1) why was Backpage.com so successful in facilitating child sex trafficking; (2) how has the impact of the internet allowed sex trafficking to flourish; and (3) how can the lessons learned from Backpage.com be used to spread awareness, improve legislation, and reduce the occurrence of trafficking in Pennsylvania? This research was completed through text reviews of literature as well as text analysis of online advertisements from Backpage.com. The results show how and why Backpage.com was effective at evading law enforcement and utilizing the law in their favor to continue illegal operations. The conclusion is that legislation efforts, law enforcement, and the local community need to work together to bring awareness to the issue and fight trafficking worldwide and in Pennsylvania.

Traffickers around the world abuse vulnerable individuals and rob them of their freedom to be safe from harm despite the international and national laws that are in place. In particular, sex trafficking, a subset of human trafficking is a form of discrimination in which people in power, typically men, take advantage of the vulnerabilities of women and children— though men are also victims—to exploit them for their services, whether for labor and/or sex. In addition, deception, fraud, force, and coercion are often used to recruit victims (UNODC 2000, Article 3(a)) although that should not be the main factor when investigating and prosecuting these crimes; for children proof of the threat or use of force or coercion is not required. Already a hidden crime due to the difficulty of identifying the traffickers and victims, the advances in internet technology have offered traffickers a new mechanism to escape detection from law enforcement. Internet offers affordability, accessibility, and anonymity –the “Triple-A Engine Effect” (Manning 2006, 133). Shawn Henry, former Executive Assistant Director of the FBI informed the public that the Internet, despite its contribution to knowledge, has many setbacks. “At any given time, there are an estimated 750,000 child predators online — and they all have a key to your house via the Internet” (FBI News Video 2011, Shawn Henry). As a result, it is time for individuals to be more cognizant of the importance of internet safety in order to combat cyber-sex trafficking. In May 2013, the use of the Internet to facilitate sex trafficking came to the fore again with the case in the Philippines in which three girls were rescued from a ring forcing them to perform live sex shows via the Internet for customers. Often the customers-- mostly Americans and Europeans--paid $56/minute for the girls to perform live sexual acts (web-cam sex) based on the customers’ typed requests transmitted via computers (de Leon 2013). In the case of the three girls, who were eight years old when the abuse started, U.S. agencies, the Philippine National Police and the non-profit Visayan Forum Foundation received tips on one of their frequent customers, Jeffrey Herschell from Washington, Pennsylvania with the help of the victims. This information helped law enforcement arrest and sentence the offender to 12 years in federal prison (Coorlim 2013).

On the one hand, the law became significantly more punitive in its approach to sexual conduct that is nonconsensual or unwanted, as evidenced by a major expansion in the definition of rape and sexual assault, and the creation of new offenses like sex trafficking, child grooming, revenge porn, and female genital mutilation. On the other hand, it became markedly more permissive in how it dealt with conduct that is consensual, a trend that can be seen, for example, in the legalization or decriminalization of sodomy, adultery, and adult pornography. This book explores the conceptual and normative implications of this divergence. In doing so, it assumes that the proper role of the criminal law in a liberal state is to protect individuals in their right not to be subjected to sexual contact against their will, while also safeguarding their right to engage in (private consensual) sexual conduct in which they do wish to participate. Although consistent in the abstract, these dual aims frequently come into conflict in practice. The book develops a framework for harmonization in the context of a wide range of nonconsensual, consensual, and aconsensual sexual offenses (hence, the "unified" nature of the theory) -- including rape-as-unconsented-to-sex, rape-by-deceit, rape-by-coercion, rape of a person who lacks capacity to consent, statutory rape, abuse of position, sexual harassment, voyeurism, indecent exposure, incest, sadomasochistic assault, prostitution, bestiality, and necrophilia"--

Despite the serious and long-term consequences for victims as well as their families, communities, and society, efforts to prevent, identify, and respond to these crimes are largely under supported, inefficient, uncoordinated, and unevaluated. Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States examines commercial sexual exploitation and sex trafficking of U.S. citizens and lawful permanent residents of the United States under age 18. According to this report, efforts to prevent, identify, and respond to these crimes require better collaborative approaches that build upon the capabilities of people and entities from a range of sectors. In addition, such efforts need to confront demand and the individuals who commit and benefit from these crimes. The report recommends increased awareness and understanding, strengthening of the law's response, strengthening of research to advance understanding and to support the development of prevention and intervention strategies, support for multi-sector and interagency collaboration, and creation of a digital information-sharing platform. A nation that is unaware of these problems or disengaged from solutions unwittingly contributes to the ongoing abuse of minors. If acted upon in a coordinated and comprehensive manner, the recommendations of Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States can help advance and strengthen the nation's emerging efforts to prevent, identify, and respond to commercial sexual exploitation and sex trafficking of minors in the United States.

In From Human Trafficking to Human Rights, Brysk, Choi-Fitzpatrick, and a cast of experts demonstrate that it is time to recognize human trafficking as more a matter of human rights and social justice, rooted in larger structural issues relating to the global economy, human security, U.S. foreign policy, and labor and gender relations. Such reframing involves overcoming several of the most difficult barriers to the development of human rights discourse: women's rights as human rights, labor rights as a confluence of structure and agency, the interdependence of migration and discrimination, the ideological and policy hegemony of the United States in setting the terms of debate, and a politics of global justice and governance. The public's understanding of human trafficking is comprised of terrible stories like these, which the media covers in dramatic, but usually short-lived bursts. The more complicated, long-term story of how policy on trafficking has evolved has been largely ignored. In The War on Human Trafficking, Anthony M. DeStefano covers a decade of reporting on the policy battles that have surrounded efforts to abolish such practices, helping readers to understand the forced labor of immigrants as a major global human rights story. DeStefano details the events leading up to the creation of the Trafficking Victims Protection Act of 2000, the federal law that first addressed the phenomenon of trafficking in persons. He assesses the effectiveness of the 2000 law and its progeny, showing the difficulties encountered by federal prosecutors in building criminal cases against traffickers. Even in its earliest forms, it operated both as a tool to repress collective organizations and enforce labour discipline, while policing the worst excesses of industrial capitalism. Recently, governments have begun to rediscover criminal law as a regulatory tool in a diverse set of areas related to labour law: 'modern slavery', penalizing irregular migrants, licensing regimes for labour market intermediaries, wage theft, supporting the enforcement of general labour standards, new forms of hybrid preventive orders, harassment at work, and industrial protest. This volume explores the political and regulatory dimensions of the new 'criminality at work' from a wide range of disciplinary perspectives, including labour law, immigration law, and health and safety regulations. There is also a growing body of research on human trafficking, but most of it has focused on trying to show that human trafficking is a problem. Wilson and Dalton explore the extent and characteristics of concrete cases of human trafficking in Columbus and Toledo, Ohio, as well as the awareness of and response to the problem by the justice systems and social service provider communities in the two cities. The authors summarize their content analysis of newspaper accounts as well as key respondent interviews that they conducted with criminal justice officials and social service providers in each site. These identified several cases of juvenile sex trafficking and forced prostitution in Toledo, as well as a smaller trafficking market centered on the forced labor of noncitizens in Columbus. Wilson and Dalton compare the two cities' considerably different responses to human trafficking, and conclude with suggestions on how to raise awareness about human trafficking and improve the responses of the criminal justice system, the juvenile justice system, and social services to the problem.
