In the post-9/11 era, politicians and policy-makers are paying more attention to the region, especially where border enforcement is concerned. Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.

While a solid foundation has been established for many specific water management problems, combining those methods and principles in a unified framework remains an ongoing challenge. This Handbook aims to expand the scope of efficient water use to include allocation of sources and quantities across uses and time, as well as integrating demand-management with supply-side substitutes. Socially efficient water use does not generally coincide with private decisions in the real world, however. Examples of mechanisms designed to incentivize efficient behavior are drawn from agricultural water use, municipal water regulation, and externalities linked to water resources. Water management is further complicated when information is costly and/or imperfect. Standard optimization frameworks are extended to allow for coordination costs, games and cooperation, and risk allocation. When operating efficiently, water markets are often viewed as a desirable means of allocation because a market price incentivizes users to move resources from low to high value activities. However, early attempts at water trading have run into many obstacles. Case studies from the United States, Australia, Europe, and Canada highlight the successes and remaining challenges of establishing efficient water markets.

The problem is that in many cases the poor already have limited access to resources, but this limit is not due to water trading. In fact, water trading is likely to expand the access to water for many small-scale farmers. Markets for Water: Potential and Performance provides an analytical framework for water market establishment. It develops the necessary conditions for water markets and illustrates how they can improve both water management and economic efficiency. The linkages between Water Information Systems and needs of decision makers are complex, but can be encapsulated in a Driving Force (Policy Needs) – Monitoring – Data Management – Reporting framework. The rapid development in water policy reforms in many sectors and growing emphasis on demand-side policy solutions to water resources management has created an information imbalance. This imbalance can be characterised in terms of an inverted pyramid with implementation of many water policy initiatives supported by little data and information, especially related to economic and financial elements, to help guide decision makers toward more effective and efficient water resources management strategies. Additionally, as stress and demands on water systems increase and water becomes a more valued resource, this tends to increase the value of water information both for water providers and users. Nevertheless, many countries are reporting that the capacity to collect water information is being undermined by a lack of resources, while expertise to collect, analyse and interpret water data for decision makers is being lost. Finally, the impact of climate change on hydrological regimes represents a key potential stress on water systems. This issue could be the catalyst for adapting policies to provide more efficient and effective use and management of water resources and advance institutional and governance reforms in the water sector.
