Book Handbook of Evidence in International Commercial Arbitration

Download or read book Handbook of Evidence in International Commercial Arbitration written by Franco Ferrari and published by Kluwer Law International B.V.. This book was released on 2022-04-07 with total page 690 pages. Available in PDF, EPUB and Kindle. Book excerpt: In arbitration, evidence provides the basis for almost every decision, be it procedural, jurisdictional, or substantive. However, users from different legal traditions may not share the same understanding as to how an arbitral tribunal ought to proceed in this regard. Therefore, it is important for lawyers to know how to collect, develop, and present evidence in arbitration proceedings, not only from a legal perspective but also from a cultural point of view. It is against this backdrop that the editors have invited a diverse group of distinguished arbitration practitioners and academics to contribute to this matchless Handbook of Evidence in International Commercial Arbitration. Key concepts and issues related to evidence in arbitration covered include the following: the normative framework on evidence in arbitration proceedings; the burden and standard of proof; means of evidence, including documents, experts, and witnesses; questions of admissibility, including issues of privilege and confidentiality; the assessment of evidence and its probative value; court assistance and sanctions. With its systematic analysis of the key concepts of evidence, holistic discussion of the applicable normative framework, cross-cultural perspectives on the taking of evidence in arbitration, and reference to case law from major arbitration hubs, this book will become an undisputed point of reference for academics and practitioners alike. Critical acclaim: “This handbook elegantly captures the range of issues that arises regarding evidence in international arbitration. Bringing together the foremost experts in the field, each contribution offers a thoughtful analysis on these issues and the compilation deserves a prominent spot in every practitioner’s arbitral library.” Chiann Bao, Independent Arbitrator (Arbitration Chambers) and Vice President of the ICC Court of Arbitration “This publication well deserves recognition as a landmark handbook on evidence in international commercial arbitration. It comprehensively discusses the whole evidentiary process from its foundations taking a comparative and harmonizing perspective as well as the burden and standards of proof to the various evidentiary means up to the assessment of evidence. Written by leading academics and practitioners from all over the world, it will be a safe haven for anyone facing discrete evidentiary issues and looking for answers to fundamental or actual questions including as to privileges, confidentiality, virtual hearings or data protection.” Professor Filip De Ly, Chair of the ILA International Commercial Arbitration Committee

Download or read book Racism on Campus written by Stephen C. Poulson and published by Routledge. This book was released on 2021-09-23 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: Drawing on content from yearbooks published by prominent colleges in Virginia, this book explores changes in race relations that have occurred at universities in the United States since the late 19th century. It juxtaposes the content published in predominantly White university yearbooks to that published by Howard University, a historically Black college. The study is a work of visual sociology, with photographs, line drawings and historical prints that provide a visual account of the institutional racism that existed at these colleges over time. It employs Bonilla-Silva’s concept of structural racism to shed light on how race ordered all aspects of social life on campuses from the period of post-Civil War Reconstruction to the present. It examines the lives of the Black men and women who worked at these schools and the racial attitudes of the White men and women who attended them. As such, Racism on Campus will appeal to scholars of sociology, history and anthropology with interests in race, racism and visual methods.

Available in PDF, EPUB and Kindle. Book excerpt: Phish has a diehard fan base and a dedicated community of enthusiasts—called Phishheads—who follow the band around the country, some fans attending every show. What may be surprising is that a significant percentage of Phishheads are Jewish. Two members of the band—bassist Mike Gordon and drummer Jonathan Fishman—were raised in Jewish households, and Phish has been known to play Hebrew songs in concert. At live shows, many attendees, some wearing T-shirts emblazoned with “Phish” written in Hebrew letters, express feeling something special—even distinctly Jewish—during their performances. As this book shows, Phish is one avenue through which many Jews find cultural and spiritual fulfillment outside the confines of traditional and institutional Jewish life. In effect, Phish fandom and the live Phish experience act as a microcosm through which we see American Jewish religious and cultural life manifest in unique and unexpected spaces. Featuring an interview with Mike Gordon and a collection of fascinating photographs, This Is Your Song Too is an in-depth look at Jewishness in the Phish universe that also provides a deeper understanding of how spirituality, ritual, and identity function in the world of rock and roll. In addition to the editors, the contributors include Evan S. Benn, Dean Budnick, Jacob A. Cohen, Benjamin David, Jessy Dressin, Josh Fleet, Mike Greenhaus, Joshua S. Ladon, Noah Munro Lehrman, Caroline Rothstein, and Isaac Kandall Slone.

Book L S Vygotsky and English in Education and the Language Arts

This book was released on 2023-10-09 with total page 503 pages. Available in PDF, EPUB and Kindle. Book excerpt: L. S. Vygotsky and English in Education and the Language Arts focuses on the hugely significant contributions of L. S. Vygotsky to research, theory, and practice in English and the Language Arts, exploring the relevance of Vygotsky’s works for today’s teachers and researchers. Drawing on his 30 years of study, Smagorinsky interprets Vygotsky in relation to literacy education, teacher education, special education, and how life outside school has an impact on how people function within them. This insightful and accessible text firstly explores Vygotsky’s early life to situate him historically and culturally and goes on to trace his understanding of human psychology as it relates to the social contexts of schools and pupils’ lives at home. Vygotsky’s pedagogical ideas are then discussed in depth, with specific attention on the role of emotions, the zone of proximal development, expanding textuality beyond writing, and his belief in the primacy of socialization. This book illuminates new areas of understanding, and challenges common perceptions available through limited and selective readings, establishing Vygotsky as a complex developmental psychologist rather than a classroom practitioner. With points for discussion and reflection provided throughout, this text will be invaluable for student teachers, teachers, and academics in the field of English and the Language Arts.

Book Towards a psychophysiological approach in physical activity exercise and sports volume II

Download or read book Towards a psychophysiological approach in physical activity exercise and sports volume II written by Pedro Forte and published by Frontiers Media SA. This book was released on 2024-07-12 with total page 118 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Research Topic is the second volume of the article collection: "Towards a Psychophysiological Approach in Physical Activity, Exercise, and Sports". Please see the first volume here: https://www.frontiersin.org/research-topics/39747/towards-a-psychophysiological-approach-in-physical-activity-exercise-and-sports/magazine. In recent years, there has been an increase in interest in mental health disorders as a result of mediatic coverage of Olympic athletes’ mental health struggles, and also due to the COVID-19 pandemic lockdowns. These phenomena helped to further exacerbate a problem already extensively present in sport and society. Therefore, applying a psychophysiological approach to physical activity, exercise, and sports research has become very popular. Indeed, mental fatigue and mental disorders are not only psychological in origin, but also require an explanation from a psychophysiological perspective due to the effective interconnection between the psychological and physiological dimensions. Psychological variables can also influence performance and the psychophysiological system has a strong effect on the control of physical capacities. Moreover, pacing behaviour, decision-making, self-regulation, and effort perception can also explain the role of the brain in physical activity and exercise management. Thus, the aim of this Research Topic is to share the impact of a psychophysiological approach in physical activity, exercise, and sports. The goal of this Topic is to address the following: • Factors determining performance, including technical/tactical, physiological, cognitive, and psychosocial; • training and competition demand; • training interventions and testing in sports; • acute and chronic effects of training in psychophysiological variables; • coaching in sports; • strength and conditioning, mental health, and performance; • recent developments within sports sciences research. This Research Topic endeavors to explore at specific themes related to physiological stress and mental well-being. Additionally, we aim to provide evidence to coaches and sports scientists highlighting the relationship between training and competition demands, related to performance. We also want to analyze the effects of strength and conditioning training, and coaching effects (acute and chronic) on psychological and physiological. Finally, it is our intention to provide scientific literature with evidence for a relationship between movement, behavior and cognition with physiological performance: the psychophysiological approach.
