Download or read book Law Street written by Wim J.M. Touw and published by iUniverse. This book was released on 2011-06-14 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: The American legal system is far from perfect. High standards of fairness and equal justice for all are lacking, and conflicts of interest are an integral part of the systems practitioners. In Law Street, author Wim J.M. Touw discusses the ills of the American legal system and investigates the roots of its dysfunction. In his analysis Touw argues that American lawyers have lost their moral and ethical moorings; he provides a unique perspective of how American lawyers have manipulated the British common law system for their own financial benefit or to advance their careers. He compares the legal system of the United States with systems in the worlds foremost democracies to illustrate how American jurisprudence has strayed from its mission. Finally, he examines the criminal law system that puts innocent people in jail and explains in detail how the tort system, the contingency fee, and the loser pays laws have turned the once noble profession of lawyering into a profitable, unregulated business corrupting the legal process. Touw argues that what is good for Wall Street is good for Law Street and explains why American bar associations do not provide proper oversight. With thorough explanations and examples, Law Street tells a story about serious flaws in the American legal system and provides a wake-up call for Americas dysfunctional and often corrupt legal system.

Download or read book The Last Writings of Thomas S Kuhn written by Thomas S. Kuhn and published by University of Chicago Press. This book was released on 2024-05-08 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: A must-read follow-up to The Structure of Scientific Revolutions, one of the most important books of the twentieth century. This book contains the text of Thomas S. Kuhn’s unfinished book, The Plurality of Worlds: An Evolutionary Theory of Scientific Development, which Kuhn himself described as a return to the central claims of The Structure of Scientific Revolutions and the problems that it raised but did not resolve. The Plurality of Worlds is preceded by two related texts that Kuhn publicly delivered but never published in English: his paper “Scientific Knowledge as Historical Product” and his Shearman Memorial Lectures, “The Presence of Past Science.” An introduction by the editor describes the origins and structure of The Plurality of Worlds and sheds light on its central philosophical problems. Kuhn’s aims in his last writings are bold. He sets out to develop an empirically grounded theory of meaning that would allow him to make sense of both the possibility of historical understanding and the inevitability of incommensurability between past and present science. In his view, incommensurability is fully compatible with a robust notion of the real world that science investigates, the rationality of scientific change, and the idea that scientific development is progressive.

Download or read book The Production of Consumer Society written by Ernst Mohr and published by transcript Verlag. This book was released on 2021-04-30 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: With a novel quality theory of consumption which treats opulence and self-restraint in consumption styles symmetrically, Ernst Mohr shows how social distance and proximity are communicated by consumption and produced by communication. He positions fringe styles with those of the mainstream in an overall stylistic system of society and analyses their encounters. Rigorously derived, the approach casts fresh light on the cultural and social evolution as well as the business models of the consumer industry. It provides a coherent interdisciplinary access to the aesthetic turn of society that has so far been treated with contradictory paradigms.

Download or read book Basic Documents on International Trade Law written by Chia-Jui Cheng and published by Kluwer Law International B.V.. This book was released on 2012-04-27 with total page 2007 pages. Available in PDF, EPUB and Kindle. Book excerpt: Anyone involved in trade law knows the time-consuming nature of obtaining primary source material and consulting each of the main trade laws. Now in its fourth edition, Basic Documents in International Trade Law solves this problem by assembling, in a single, easy-to-use resource, a very comprehensive collection of the most important and frequently used documents on the law of international trade. In addition to its obvious practical value, this work reveals much about the process of harmonization in international trade law and the operation of the key international trade bodies. This makes the book a helpful reference for international business lawyers, researchers, legislators and government officials in the field. Since the successful publication of the previous editions of the book, the appearance of new conventions and model laws has considerably enriched the law of international trade, and the present edition contains a wealth of new material. The book has been substantially revised and several new instruments have been included. Among the most significantly important improvements to this new edition are new chapters added to different parts of the book, a redesigned and thoroughly revised Part 6 reflecting the expansion of intellectual property rights under the framework of treaties administered by World International Property Organization, and bibliographies and other research resources updated and enlarged to include an extraordinarily rich collection of books and articles in many trading languages besides English, including, for the first time, major Chinese works in the international trade law field. As the late Prof. Clive M. Schmitthoff commented on the first edition, the book ‘is not only of practical usefulness but has also considerable jurisprudential value’, and ‘reveals the methodology of the harmonization process in the area of international trade law’. The International Business Lawyer first commented in 1987 that the book ‘can only be described as a “vade mecum” for every international business lawyer’, an assessment that now seems more merited than ever.

Download or read book The Power of Law in a Transnational World written by Franz von Benda-Beckmann and published by Berghahn Books. This book was released on 2012 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: How is law mobilized and who has the power and authority to construct its meaning? This important volume examines this question as well as how law is constituted and reconfigured through social processes that frame both its continuity and transformation over time. The volume highlights how power is deployed under conditions of legal pluralism, exploring its effects on livelihoods and on social institutions, including the state. Such an approach not only demonstrates how the state, through its various development programs and organizational structures, attempts to control territory and people, but also relates the mechanisms of state control to other legal modes of control and regulation at both local and supranational levels.
