Certainly, volumes abound dealing with emerging sexualities in Canada and new sexual freedoms. This book seeks to do more than tell a story of broad generalities about the law. It forges the links between the history of law and modern iterations of judgments pertaining to that law. Hence the uncomfortable line between Victorian morality (often) and modern regulation, is thematically explored through the book. More modern iterations of sexual regulation in Canada are being deployed and, in this book, the authors explore the interplay between emerging digital technologies and legal regulation. Newer laws in Canada have been drafted to recognize that sexual expression can be a means of violence inherently, and thus an exploration of modern sexual digital expression and its emerging jurisprudence represent a new frontier in the regulation of sex and sexuality in Canada. We explore how legal regulation has responded to these new crimes.

Book excerpt: In Bedford, the Supreme Court struck down prohibitions against communicating in public for the purpose of sex work, living on its avails, and working from a bawdy house. Its narrow constitutional reasoning nevertheless allowed Parliament to respond by adopting the “end demand” or “Nordic Model” of sex work regulation, an approach widely criticized for failing to ensure sex worker safety. Judging Sex Work takes stock of the Bedford decision, arguing that the constitutional issue was improperly framed. Because the most vulnerable sex workers have no realistic choice but to commit the impugned offences, they already possess a legal defence. The constitutionality of the sex work laws should therefore have been assessed by their application to those who choose sex work, an approach that militates in favour of upholding these laws based on current jurisprudence. While this approach leads to the former restrictions on sex work being constitutional, it also has the salutary effect of forcing litigants to consider a more pressing question: Can sex work be rationalized as a criminal matter at all?

Accordingly, green criminology has endeavored to understand the causes and consequences of air and water pollution, biodiversity loss, climate change, corporate environmental crime (e.g., illegal waste disposal), food production and distribution, resource extraction and exploitation, and wildlife trade and trafficking, while also exploring potential responses to these issues. Book excerpt: Canadian laws pertaining to pornography and bawdy houses were first developed during the Victorian era, when "non-normative" sexualities were understood as a corruption of conservative morals and harmful to society as a whole. Tracing the socio-legal history of contemporary obscenity and indecency laws, Kramar and Jochelson contend that the law continues to function to protect society from harm. Today, rather than seeing harm to conservative values, the court sees harm to liberal political values. While reforms have been made, especially in light of feminist and queer challenges, Kramar and Jochelson use Foucault's governmentality framework to show that the liberal harm strategy for governing obscenity and indecency continues to disguise power.
