Book Sex Drugs Rock Roll and Moral Dirigisme

Download or read book Sex Drugs Rock Roll and Moral Dirigisme written by Michele Alexandre and published by . This book was released on 2009 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Article builds upon various scholarly critics of moralistic laws to argue that legal prohibition of drugs and prostitution is inefficient. In so doing, it relies on economists' scholarship, which has demonstrated that the high costs of regulation are not justified, considering the minimal success of these regulations as well as the harm caused by those regulations. Philosophers, for millennia, have grappled with formulating principles of morality and have attempted to determine which of those principles ought to be codified and imposed as societal rules of law on individuals. Attempts to coerce individuals into adopting certain behavioral patterns or forgo destructive ones have been referred to as “moral dirigisme”. Moral dirigisme manifests itself in “the attempt or tendency to control certain kinds of moral behavior by formal legal means." (See, e.g., Mario J. Rizzo, The Problem of Moral Dirigisme: A New Argument Against Moralistic Legislation, 1 N.Y.U. J.L. & LIBERTY 789, 791 (2005). Moral dirigisme (John Stuart Mill, On Liberty 13 (Stefan Collini ed., 1989) (1859) is an economic term, which describes an economic structure for which the government provides strong direction. (See generally Élie Cohen, Le Colbertisme “High Tech”: Économie Des Telecom et du Grand Projet (1992); David Baker, The Political Economy of Fascism: Myth or Reality, or Myth and Reality?, 11 NEW POL. ECON., 157, 227-50 (2006). The term dirigisme derives from the French word diriger, which means to guide. (see WordReference.com, French to English Dictionary, (last visited Sept. 3, 2009). Moral dirigisme, by analogy, refers to the underlying philosophy which believes that moral behaviors can be changed through formal regulation. It is referred to, by Mario J. Rizzo, as “the attempt or tendency to control certain kinds of moral behavior by formal legal means.” (See Rizzo, supra note 2, at 791). Rizzo views acts by the state to prohibit or authorize certain conduct of individuals in an attempt to force them to act morally as flawed. Id. The laws prohibiting drugs and prostitution serve as perfect examples of implementation of a moral dirigiste philosophy. I contend in this Article that the dirigiste approach to drugs and prostitution is erroneous and inefficient. From Plato's Socrates to Kant's Categorical Imperatives to Hume's observations, philosophers have confronted the nebulous intersection of absolutely necessary laws and purely beneficence-inducing laws, which cannot be implanted as a product of coercion. While the principles of justice have generally been perceived as capable of inspiring precise laws, other principles such as those guiding beneficence have been viewed by philosophers as more contingent on the individual's state of mind or circumstances and less likely to be regulated by formal rules. This Article explores the proper role the law should play in regulating behaviors (such as drug use and/or in prostitution) that society deems harmful, but that are resistant to prohibition. Additionally, it considers items deemed harmful to the public, but not subject to any form of prohibition. Furthermore, it re-examines the consequences of U.S. drug and prostitution policy, focusing on the inevitable “black market” effects of the punitive style of enforcement, and initiates serious consideration of policy alternatives to discourage drug use and limit the number of vulnerable women engaging in prostitution. Consequently, the Article is divided as follows. Part II considers the inefficiency of the prohibition of drugs and prostitution. Part III discusses the underlying legal and philosophical theories that support prohibitory legislation and analyzes why prohibition of drugs and prostitution, although a popular default mechanism, is ineffective at eradicating these behaviors. Part III also identifies the Smithian-Humean view of justice as a basis to evaluate prohibition-based laws. Part IV explores the issues inherent in the prohibition of drugs and considers alternative approaches. Part V explores issues that result from the prohibition of prostitution and Part VI proposes an alternative framework to the prohibition of prostitution. Part VII explores ways of preventing pro-prostitution regulations from strengthening the sex trafficking market. Finally, Part VIII borrows from philosophical frameworks to formulate a standard that helps differentiate between effective and ineffective prohibition. Through an analysis of the unintended effects of prohibition, this Article provides a strong economic and legal argument for the legalization of prostitution and, at the very least, marginal changes in U.S. drug policy.

Book excerpt: An intimate and original look at the lives of Nevada’s legal sex workers through the voices of current and former employees, brothel owners, madams, and local law enforcement The state of Nevada is the only jurisdiction in the United States where prostitution is legal. Wrapped in moral judgments about sexual conduct and shrouded in titillating intrigue, stories about Nevada’s legal brothels regularly steal headlines. The stigma and secrecy pervading sex work contribute to experiences of oppression and unfair labor practices for many legal prostitutes in Nevada. Sex and Stigma engages with stories of women living and working in these “hidden” organizations to interrogate issues related to labor rights, secrecy, privacy, and discrimination in the current legal brothel system. Including interviews with current and former legal sex workers, brothel owners, madams, local police, and others, Sex and Stigma examines how widespread beliefs about the immorality of selling sexual services have influenced the history and laws of legal brothel prostitution. With unique access to a difficult-to-reach population, the authors privilege the voices of brothel workers throughout the book as they reflect on their struggles to engage in their communities, conduct business, maintain personal relationships, and transition out of the industry. Further, the authors examine how these brothels operate like other kinds of legal entities, and how individuals contend with balancing work and non-work commitments, navigate work place cultures, and handle managerial relationships. Sex and Stigma serves as a resource on the policies guiding legal prostitution in Nevada and provides an intimate look at the lived experiences of women performing sex work.

Book Using the Narcotrafico Threat to Build Public Administration Capacity between the US and Mexico

Download or read book Using the Narcotrafico Threat to Build Public Administration Capacity between the US and Mexico written by Donald E. Klingner and published by CRC Press. This book was released on 2014-02-25 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: The current drug trafficking crisis between the US and Mexico is a "perfect storm" that has caused deaths, disappearances, and widespread fear of violence and insecurity in the border area between these two countries. Current US drug control policies with Mexico are based on a militarized system of border control and characterized by domestic gridlock over drug control and immigration reform. However, because drug trafficking and other underlying issues have both domestic and international consequences, they cannot be resolved unless both countries work together. Using the "Narcotrafico" Threat to Build Public Administration Capacity between the US and Mexico explores how they can do exactly that. Co-edited by two public administration scholars from Mexico and the US and comprising chapters by 18 other experts from Mexico, Canada, and the US, the book demonstrates how the current situation of drug trafficking and violence, on top of the other existing perceptions and conditions, creates a real opportunity for the US to build relationships with its Mexican counterparts at state, local, national, and NGO levels. With chapters written by leading experts working in a broad spectrum of international and domestic US-Mexico policy issues, the book covers immigration, drug flow and conflict, gun-running, money laundering, education and economic and community development in both countries.. Only by supporting bi-national drug policies based on mutual understanding of the border as something that both separates and unites the US and Mexico will it be possible to develop cooperative policies that can lead from militarization to regularization of the US-Mexico border. Twenty years after the signing of NAFTA (North American Free Trade Agreement) in 1994, it is time to recognize the link between effective drug control policies and the emergence of North America as a regional economic, social, and political powerhouse capable of successfully competing with the European Union, China, and other emerging regions in our increasingly globalized world, this book offers concrete, long-term solutions for building cooperative and shared public administrative capacity on both sides of the border.

Available in PDF, EPUB and Kindle. Book excerpt: The legal definition of child pornography is, at best, unclear. In part because of this ambiguity and in part because of the nature of the crime itself, the prosecution and sentencing of perpetrators, the protection of and restitution for victims, and the means for preventing repeat offenses are deeply controversial. In Refining Child Pornography Law, experts in law, sociology, and social work examine child pornography law and its consequences in an effort to clarify the questions and begin to formulate answers. Focusing on the roles of language and crime definition, the contributors discuss the increasing visibility child pornography plays in the national conversation about child safety, and present a range of views regarding the punishment of those who produce, distribute, and possess materials that may be considered child pornography.

How did a chemist's quest to create a drug to ease the pain of childbirth result in the creation of LSD? Why do goats partake in oral sex, and how can a horse (or even a table) make us weak in the knees? And how on earth could the revered 'father of anatomy' not know where the clitoris was? From tortoiseshell condoms to superstar athletes on hallucinogens, these burning questions are explored and dissected, mixed with insights from some of the world's bravest, cleverest and downright weirdest scientist experimenting on the edge - and themselves. It's a sharp shocker, an eye opener, asking the big questions about what it means to be human, about consciousness and happiness. It'll pull you in and gross you out. Exuberantly curious and shamelessly exuberant, Guerilla Science's Zoe Cormier reinvents popular science for a new generation by breaking all the rules. Let's rock.
