La Iglesia estará presente en todo el proceso de formación de las nuevas entidades estatales, y a diferencia de lo acaecido en otros nacientes Estados de Derecho, caso de Francia o Estados Unidos, por ejemplo, que proclamarán la plena separación del Estado y las Iglesias, en las naciones americanas, sus textos constitucionales asumirán el carácter de confesionales, excluyentes e intolerantes, al menos en su primera andadura del Estado Liberal. En suma, los autores presentan una panorámica completa y acabada de una faceta de la historia política y del constitucionalismo latinoamericano, que es fundamental para la comprensión del mismo, incluso en la época actual, en la que todavía algunos textos del presente siglo, caso por ejemplo de la República Bolivariana de Venezuela, de marcado carácter socialista, contienen en su Preámbulo invocaciones a Dios, aspecto poco estudiado hasta el momento y que marca una profunda diferencia con el desarrollo del constitucionalismo contemporáneo, tanto europeo como norteamericano y que en gran medida ha marcado el devenir del mismo.

And, with recent changes in the composition of the Supreme Court, First Amendment law concerning religion is likely to change dramatically in the years ahead. In The Religion Clauses, Erwin Chemerinsky and Howard Gillman, two of America's leading constitutional scholars, begin by explaining how freedom of religion is enshrined in the First Amendment through two provisions. They defend a robust view of both clauses and work from the premise that that the establishment clause is best understood, in the words of Thomas Jefferson, as creating a wall separating church and state. After examining all the major approaches to the meaning of the Constitution's religion clauses, they contend that the best approaches are for the government to be strictly secular and for there to be no special exemptions for religious people from neutral and general laws that others must obey. In an America that is only becoming more diverse with respect to religion, this is not only the fairest approach, but the one most in tune with what the First Amendment actually prescribes. The framers of the Constitution's Bill of Rights began their blueprint for freedom by drawing exactly such a line. The first clauses of the First Amendment provide: "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof." The justices of the Supreme Court have not been wanting for advice from self-appointed guardians. The difficulty with such advice is that the contestants are more convincing when they criticize their opponents' interpretations than when they seek to establish the validity of their own. Religion and the Law examines the actions and words of the Supreme Court in applying constitutional language to the controversies that have come before it. Lest such an effort be reduced to recitation, these cases are measured against a "neutral principle" that will give the most appropriate scope to the religion clauses in such a manner as to provide guidance for legislatures and courts. This neutral principle has been framed in reliance on the Aristotelian axiom that "it is the mark of an educated man to seek precision in each class of things just so far as the nature of the subject admits." One of the fundamental difficulties with the contemporary discussion of the "hot button" issue has been the failure to distinguish two separable problems: the constitutional issue--in the narrow sense of the meaning to be given to the language of the First Amendment by the Supreme Court--and the broader question of the ideal relationship that should exist between church and state. This is a classic study by one of the great theorists of American constitutional law.

It presents a human rights-based assessment of the various modes of state–religion identification and of the various forms of state practice that surround and characterize these different state–religion models. A close assessment of norms of human rights law substantiates that, although human rights law on the face of it is seemingly neutral to the issue of state–religion identification, legal principles can be extrapolated that have a profound bearing on the question of legitimacy of the possible diverse relationships that may exist between the state and religion. A range of thematic case studies on, among other issues, Establishment of Religion & the ‘Equal Religious Rights of Others’, Religion & Freedom of Expression, Religion & Political Rights, Religion & Educational Rights, Religion & Freedom of Association and Religion & Equal Employment Opportunities, demonstrates that existing regimes of positive state identification with religion are not devoid of forms of institutionalised discrimination and de facto practices of discrimination on grounds of religion or belief (or lack thereof). At the same time, it is observed by the author that in some secular or separationist states the ideals of state secularism and separationism have come to be considered ends in themselves. This has given rise to situations where the principles of secularism and separationism are construed so as to impose illegitimate limits on the activities of religions or illegitimate limits on the individual manifestation of certain beliefs. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people’s fundamental right to be governed, at all times, in a religiously neutral manner.
