For historicalcontext, it first briefly discusses the evolution of federal sentencing during the past fourdecades, including the landmark passage of the Sentencing Reform Act of 1984 (SRA),1 inwhich Congress established a new federal sentencing system based primarily on sentencingguidelines, as well as key Supreme Court decisions concerning the guidelines. It thendescribes the nature of federal sentences today and the process by which such sentencesare imposed. The final parts of this paper address appellate review of sentences; therevocation of offenders' terms of probation and supervised release; the process whereby theUnited States Sentencing Commission (the Commission) amends the guidelines; and theCommission's collection and analysis of sentencing data.

Book excerpt: Increasingly, criminal justice professionals have argued that dwindling prison space should be reserved for the most serious and dangerous offenders, necessitating a reconsideration of alternative sanctions for first-time and nonviolent offenders. This paper analyzes alternative sentences for federal offenders and, specifically, United States citizens sentenced under various types of alternatives. This analysis describes current federal sentencing policy governing alternative sentences and examines offenders with alternative sentences using the United States Sentencing Commission’s data. An analysis of factors associated with alternative sentences imposed for eligible offenders provides insight into considerations made by federal sentencing courts in determining whether to impose alternatives. Recidivism refers to a person's relapse into criminal behavior, often after the person receives sanctions or undergoes interventions for a previous crime. Recidivism is typically measured by criminal acts that resulted in the re-arrest, re-conviction, and/or re-incarceration of the offender over a specified period of time. Recent developments, particularly public attention to the size of the federal prison population and the cost of incarceration have refocused the Commission's interest on the recidivism of federal offenders. Virtually all offenders convicted of a federal crime are released from prison eventually and return to society or, in the case of illegal aliens, are deported to their country of origin. Yet in fiscal year 2013 federal judges imposed a sentence of life imprisonment without parole on 153 offenders. Another 168 offenders received a sentence of a specific term of years that was so long it had the practical effect of being a life sentence. Although together these offenders represent only 0.4 percent of all offenders sentenced that year, this type of sentence sets them apart from the rest of the offender population. This report examines life sentences in the federal system and the offenders on whom this punishment is imposed. There are numerous federal criminal statutes that authorize a life imprisonment sentence to be imposed as the maximum sentence. The most commonly used of these statutes involve drug trafficking, racketeering, and firearms crimes. Additionally, there are at least 45 statutes that require a life sentence to be imposed as the minimum penalty. These mandatory minimum penalties generally are required in cases involving the killing of a federal official or other government employee, piracy, or repeat offenses involving drug trafficking or weapons. In fiscal year 2013, 69 of the 153 offenders who received a sentence of life imprisonment were subject to a mandatory minimum penalty requiring the court to impose that sentence.

Part IB has been the focus of a number of criticisms. At a general level it has been said that Part IB: is unclear about whether it intends to achieve greater equality of treatment between federal offenders serving sentences in different states and territories; is complex and ambiguous; and omits any detailed reference to the aims and purposes of sentencing. Specific provisions have been variously criticised for their complexity, poor drafting, inflexibility, lack of sufficient scope or because they lead to undesirable practical outcomes... Part IB has been the subject of some amendment since 1989 but there has been no major review since its introduction. An internal review of Part IB was commenced by the Attorney-General's Department in the 1990s.
