Book excerpt: When we published our initial work on the Seminole Wars in 2004, we lamented the fact that such an important series of events was widely unknown to the American public in general and to the majority of Floridians. Not that we should have been surprised: The war was fought in one small corner of the nation and therefore of little concern to Americans as a whole, and most Floridians weren’t born in the state and would have had little opportunity to learn about the wars. Yet it shouldn’t have been that way. The Seminole Wars were a major conflict for the nation and arguably one of the most formative events for the State of Florida. The Indian Wars of the American West are famous worldwide, yet the Seminole Wars were bigger than any western Indian war. The foundations for most of Florida’s great cities are a result of the Seminole Wars, yet few of those cities’ residents are aware of the fact. It was an historical oversight we felt was in need of correction.

Book excerpt: The First Seminole War of 1816–1818 played a critical role in shaping how the United States demarcated its spatial and legal boundaries during the early years of the republic. Rooted in notions of American exceptionalism, manifest destiny, and racism, the legal framework that emerged from the war laid the groundwork for the Monroe Doctrine, the Dred Scott decision, and U.S. westward expansion over the course of the nineteenth century, as Deborah Rosen explains in Border Law. When General Andrew Jackson’s troops invaded Spanish-ruled Florida in the late 1810s, they seized forts, destroyed towns, and captured or killed Spaniards, Britons, Creeks, Seminoles, and African-descended people. As Rosen shows, Americans vigorously debated these aggressive actions and raised pressing questions about the rights of wartime prisoners, the use of military tribunals, the nature of sovereignty, the rules for operating across territorial borders, the validity of preemptive strikes, and the role of race in determining legal rights. Proponents of Jackson’s Florida campaigns claimed a place for the United States as a member of the European diplomatic community while at the same time asserting a regional sphere of influence and new rules regarding the application of international law. American justifications for the incursions, which allocated rights along racial lines and allowed broad leeway for extraterritorial action, forged a more unified national identity and set a precedent for an assertive foreign policy.

Bearing in mindthat a portion of the thirteen thousand dollars which the United States stipulated to' pay to Blunt and Elliott, (three thousand dollars of which was paid at the con elusion of the treaty, and ten thousand to be paid when they commence removing): was in consideration of the relinqui'shment of their reserve to the United States, what proportion of the whole amount shall be paid to them'.2 Justice, it seems to me, requires that the whole amount of the value of the land, as estimated at the conclusion of the treaty, (which Colonel Gadsden informs me was six thousand dollars, ) should be paid to them, as on their removal the United States will come into immediate and undis pated possession; and as death has more effectually relieved the United States from the incumbrance of those who died than the commencement of their emigration were they living could possibly do, it seems to me that no deduction'should be made for them.
