Download or read book Immigration and Criminal Law in the European Union written by Elspeth Guild and published by BRILL. This book was released on 2006-06-01 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a study of the legal framework on criminal measures on trafficking and/or smuggling and facilitating illegal entry in six Member States: France, Germany, Italy, the Netherlands, Spain and the UK, and the European Union. This issue is at the nexus of migration and criminal law. The system of criminal law in the Member States is a central part of the balance of the powers of the authorities and the rights of the citizen. The way in which civil liberties of the individual are weighed in comparison with public protection duties by the authorities is in essence a constitutional issue. The treatment of foreigners, in particular as regards their entry onto the territory and residence is not part of the constitutional settlements, but a field governed by state discretion and exceptionalism. The rules and administrative measures regarding entry, residence and expulsion of foreigners is not subject to the same civil liberties guarantees of due process as apply in criminal law. This comparative study examines how, in each Member State, the insertion of immigration into criminal law takes place. Do the rules of criminal law in respect of due process take precedence over the lower evidential and procedural requirements which are applied in the field of immigration? How does the criminal justice system deal with this new field where central constitutional issues are not present? There are two levels on which the insertion of immigration into criminal law takes place – the legal and the social. This book deals with both. On the one hand it looks at the laws and the court decisions on criminal trials in respect of immigrants for immigration related offences, on the other hand it looks at how the society (political actors, media, interest groups etc) discuss and develop this issue. This book is designed for policymakers, academics, students and activists concerned about the European Union.
Download or read book Security A Multidisciplinary Normative Approach written by Cecilia M. Bailliet and published by BRILL. This book was released on 2009-08-28 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Security is an all-encompassing term of art which is subject to diverse interpretations and understandings. It includes notions of protection against transnational threats, including terrorism, inter- and intra-state conflict, nuclear proliferation, forced migration, violation of women’s rights, climate change, etc. The papers in this collection provide fresh voices in the security debate, uniting scholars from different fields of law and philosophy to address normative gaps in interpretation, evolution and application. Part I considers calls for an expanded mandate for the UN Security Council and regional international organisations. Part II reviews innovations within the arena of international humanitarian law, including whether it is possible to balance human rights and humanitarian law standards in peacekeeping operations, responses to “voluntary human shielding”, and normative evolution in the removal of anti-personnel mines and the ban on cluster munitions. Part III embarks upon the realm of Ethics and Democracy: assessing the engagement of private soldiers and the legitimacy of targeted strikes pursuant to the “responsibility to prevent terrorism”. It also considers internal conflicts within the notion of “democratic security”, affirms the procedural guarantees of habeas corpus and non-refoulement as central elements of global justice, and calls for evaluation of gender equity as a measure of state fragility. Part IV confronts the global challenge of climate change as a security threat. Finally, Part V provides a practitioner’s perspective which discusses possible grounds for a gap between academics and security practitioners.

Download or read book Threats to Peace and International Security Asia versus West written by Juan Cayón Peña and published by Springer Nature. This book was released on 2023-03-27 with total page 251 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book aims to analyze from a multidisciplinary perspective the current geopolitical conflict between East and West, between two differentiated and apparently conflicting cosmogonic visions. The geopolitical evolution of the current panorama seems to lead to a new world in the field of international relations, a new board played on a planetary level. Once again, bloc geopolitics can be glimpsed in the immediate future, in which the most important actors such as Russia, China, the United States of America, and the European Union are called to position themselves with respect to the territorial and strategic ambitions of the opponent. International law seems to be overwhelmed by military actions and factual pressure on the ground, while the battle of ideas extends to the technological field and cyberspace. The different origins of the authors, with extensive academic, military, police forces, and business experience undoubtedly enriches the unique perspective that this work intends to address, always in the attempt to enforce international law and the channels of dialogue between nations, such as the best solution to conflicts.

Download or read book South America and Peace Operations written by Kai Michael Kenkel and published by Routledge. This book was released on 2013-07-18 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the first English-language work to focus specifically on South America in the context of peace operations. The region of South America has been undergoing significant changes recently with regard to its attitudes towards participation in peace operations. Leaving behind a strong reluctance with regard to intervention, the states have recently taken on a much stronger presence among UN peacekeepers. The foremost showcase of this more robust and responsible stance has been MINUSTAH, the current UN mission in Haiti. South American contributors provide over half the operation’s troops, and the Force Commander is provided by Brazil. This book is intended as an introduction for researchers to the nexus of issues surrounding South America’s increasing influence as a contributor to peace operations. The authors provide the reader with a historically and theoretically grounded understanding of what motivates defence policy and decisions on intervention in the region. Featuring contributions from prominent thinkers in the field and a broad range of case studies, this volume successfully combines practical applicability with diversity of analysis. This book will be of much interest to students of peacekeeping, South American politics, peace and conflict studies, security studies and International Relations in general.
Download or read book Security and Defence Ethical and Legal Challenges in the Face of Current Conflicts written by Juan Cayón Peña and published by Springer Nature. This book was released on 2022-03-17 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book aspires to face the challenge of analyzing with due academic rigor, always in the paradigm of security and advanced sciences, but without forgetting the ethical questions that our world raises every day. The work is divided into two main sections: the first section is focused on the cyber world, with not only technical but also legal derivations given the expansion of vulnerabilities and our technological dependence. The second section, with a more interdisciplinary nature, runs through undeniably topical issues such as territorial problems and the potential decline of the traditional States, the communicational impact of information management and false news, or the commitment to essential freedoms for the West. This book connects advanced technologies and ethical issues and includes discussions on recent crises such as COVID-19. It also provides an interdisciplinary view on the ethical issues for security technologies.
