Book Section 504 Student Issues Legal Requirements and Practical Recommendations

Download or read book Section 504 Student Issues Legal Requirements and Practical Recommendations written by Perry Alan Zirkel and published by . This book was released on 2005 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Educators who do not work directly with Section 504 often confuse this provision of federal law on disability discrimination with special education under the Individuals with Disabilities Education Act (IDEA). Accurate and practical information can be hard to find. In this short guide, legal scholar Perry Zirkel sorts out the issues. This book is designed to be a practical primer on the interrelated federal civil rights laws concerning disability discrimination, namely, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA) of 1990. Although an unfunded mandate, Section 504 applies to school districts because they receive federal funds. ADA, which uses the same definition of disability as Section 504, applies to "public entities" (for example, schools), in addition to private places of public accommodation. The definition of disability in IDEA differs from that used in Section 504 and ADA. This book specifically explores student issues in K-12 public education as they are affected by the requirements of Section 504 and ADA. In addressing student issues in K-12 public education, the focus is "504-alone" students, meaning those students who are not protected under the narrower definition of disability contained in IDEA. Students protected under IDEA have "double coverage" because they also are protected under Section 504.

Even though over 50 percent of students with disabilities are now educated in general education classes, most teachers are not required to complete coursework in special education law and can unwittingly expose themselves and their schools to liability for violating the rights of students with disabilities. This practitioner’s guide explicitly addresses the major issues and legal complexities educators inevitably face when dealing with special education legal and policy issues. Using case-based learning to synthesize important legal concepts and principles from leading special education legal cases, this text guides educators, administrators, and parents alike toward a thorough understanding of, and the ability to navigate, many of the current and pressing legal concerns in special education.

Available in PDF, EPUB and Kindle. Book excerpt: Functioning both as an introduction for people with no special education expertise and as a reference by special educators, advocates, and attorneys, the text makes clear all the related laws, which share some of the same language and have been a constant source of confusion to students and education scholars alike. The work proceeds smoothly from definitions to examples to case studies, enabling the reader to quickly gain an understanding of special education law and practice. Legal ambiguities, especially common to laws and regulations sharing similar language (such as the Americans with Disabilities Act and the Rehabilitation Act of 1973), are examined. Due process mandates and hearing procedures are examined in detail. Legal guidelines for safely accommodating students with communicable diseases are presented, as are definitions and eligibility issues for students diagnosed as having one of the attention deficit disorders. In this up-to-date overview, Daugherty demystifies special education and related law, making this an invaluable tool for students and education scholars, caregivers, and all others who have an interest in special education.
