This volume of documents covers the occupation of Iraq from the planning stages of the invasion of Iraq in early 2002 to the transfer of governing authority to the Iraqi Interim Government on 28 June 2004. The book presents 595 selected documents including the first complete set of all Regulations, Orders, Memoranda and Public Notices issued by the US-led occupation administration of Iraq, the Coalition Provisional Authority (CPA), several of which were never published on the CPA`s website or promulgated in Alwaqai Aliraqiya, the Official Gazette of Iraq. Some of these legal acts have shaped the economic and political system of present day Iraq and will be part of the country`s legal order for years to come. The book also includes some 120 other CPA and CPA-related documents selected from more than 5000 unclassified CPA documents and received under freedom of information requests lodged in the United States, the United Kingdom, Australia and Switzerland. These documents include instructions and proclamations to the Iraqi people in the early stages of the occupation, organizational charts, internal legal opinions, diplomatic notes, international agreements concluded by the CPA with other States, and numerous internal memoranda for the head of the CPA, Ambassador Paul L Bremer, on legal, diplomatic and political issues. The book also presents for the first time all 235 resolutions passed by the Iraqi Governing Council (IGC) between July 2003 and June 2004. The resolutions as well as many of the 25 other important IGC documents (including various political statements, press releases and decrees of the Council`s Higher National De-Ba`athification Commission) have been translated from Arabic and are presented here for the first time in English. These documents are complemented by the relevant United Nations documents on the occupation of Iraq as well as some 50 policy documents of the United States, the United Kingdom and the Iraqi opposition movement as well as all relevant fatwas (religious rulings) of Grand Ayatollah Ali al-Sistani which shaped the internal Iraqi political process during the occupation. This collection archives these important documents for future use and makes them easily accessible to researchers and professionals. Considering that the main source of information for the occupying powers in Iraq were the precedents set during the First and Second World Wars, the occupation of Iraq will serve as a modern precedent for future administrations of occupied territory. The documents are made easily accessible by a comprehensive table of documents, a list of abbreviations, more than 1100 explanatory notes and cross-references and a substantive subject index. This volume is the second on The Occupation of Iraq. It is complemented by a monograph by the same author which, on the basis of the documents collection, presents a comprehensive analysis of The Governance of Occupied Territory in Contemporary International Law.

Book excerpt: The Committee's report examines the UK Government's diplomatic handling of the seizure of eight Royal Navy sailors and seven Royal Marines by the Iranian Revolutionary Guard in the Shatt al-Arab waterway in March 2007. Issues discussed include: Iran's objectives and strategy during this incident, the Government's diplomatic strategy, the role of regional states and the United States, the sale of stories by captured personnel to the media, and the value of diplomacy to resolve such incidents. Amongst its findings, the report condemns the treatment of the British personnel by Iranian authorities as unacceptable, particularly the use of public confessions and its refusal to grant consular access to detainees. It broadly supports the Government's dual-track diplomatic approach against Iran but criticises the Government's failure to engage with the appropriate interlocutors within the Iranian regime at a sufficiently early stage. The Committee also finds that the MoD's decision to allow returning detainees to sell their stories to the media displayed a disturbing lack of judgement and calls on the Foreign & Commonwealth Office to state in its response to the report who took the decision to give authorisation. Overall, the Committee supports the FCO's overall approach during the crisis, despite some tactical mistakes, and argues that the incident shows the value of diplomacy to resolve a crisis peacefully.

Book excerpt: Although this report mainly examines the foreign policy aspects of the Lisbon Treaty, the Committee makes some general comments on the process leading to signing of the Treaty. Chapters examine the 2007 Intergovernmental Conference process, foreign policy in that process, foreign policy in the Lisbon Treaty, new foreign policy posts, the European External Action Service, and the European Security and Defence Policy. The Government should have provided more information to Parliament during Spring 2007 about its approach to the renewed EU Treaty reform process. Parliament was entitled to expect adequate time to be consulted and to be able to make an input into the contents of the Treaty, through the Government. After the Treaty was finalised, Parliament was also entitled to have adequate time to make a thorough examination of the Treaty's detailed impact on the EU and the United Kingdom constitution. Parliament has been denied these opportunities, on both counts. The procedure followed meant that the 2007 Intergovernmental Conference mandate was agreed with little scope for UK public or Parliamentary debate and engagement. This sets an unfortunate precedent which is damaging to the credibility of the institutional reform process itself. The Committee believes the creation of the post of High representative for Foreign Affairs and Security Policy, and of the European External Action Service, represent major and significant innovations in the EU's foreign policy-making machinery. These developments, and two UK-inspired Declarations on the Common Foreign and Security Policy, are the only material differences between the provisions on foreign affairs in the Constitutional Treaty and those in the Lisbon Treaty.

The Committee states that the Government has acted decisively in some Overseas Territories but in some other cases, has been too hands-off (eg. the corruption allegations on the Turks & Caicos Islands). Also that the choice of Governor for a Territory is crucial. Finally, the Committee deplores any retaliatory measures taken against indivduals who have assisted the Committee. The BBC World Service and the British Council are the main government-funded bodies involved in public diplomacy activity, and in 2004-05, they received £225 million and £172 million of grant-in-aid respectively. The Committee's report examines the work of these two organisations, in light of the recommendations of the review by Lord Carter of Cole (more details available at http://www.fco.gov.uk/servlet/Front?pagename=OpenMarket/Xcelerate/ShowPageandc=Pageandcid=1007029395249) on the effectiveness of the Government's public diplomacy work, published in December 2005. The report makes 31 conclusions and recommendations, including the need for the Foreign Office to support an increase in the grant-in-aid funding for the BBC World Service so that it can introduce other television services such as the Arabic television news service; and that although it is appropriate for a Foreign Office minister to chair the new Public Diplomacy Strategy and Performance Management Board to ensure parliamentary accountability, this must not be allowed to compromise the editorial independence of the BBC World Service or the operational independence of the British Council.

The report reviews other countries' experience of using major sporting events for public diplomacy purposes. The Games offer an unparalleled opportunity to promote UK business, trade and inward investment. The Committee recommends holding a major trade event close to or during the Games to secure the maximum commercial benefit to the national economy. The FCO should also make more of the claim that the 2012 Games will be "the world's first sustainable Games", publicising around the world the many examples of environmental good practice in the planning and building of the event. And it should continue to use the Games to promote British culture and values at home and abroad, emphasising that London is an open and welcoming city, and that the UK is a diverse, inclusive and friendly country. The Committee is worried that budget cuts may result in the FCO's work related to the Olympics becoming a matter solely of individual initiatives by embassies and High Commissions, without adequate central co-ordination. The Committee recommends that the FCO should form a 'rapid response unit', set up well before the Games, which can rebut or challenge negative stories appearing in the world media.
