Book excerpt: A cross-party committee of MPs warns that the rushed timetable of one of the government's flagship bills could risk restoring the public's faith in Parliament while significantly limiting scrutiny of the bill's impact. The 3rd report from the Political and Constitutional Reform Committee (HCP 437, ISBN 9780215554895) of the 2010-11 session says that for primarily political reasons, the Parliamentary Voting System and Constituencies Bill links two provisions which could have been considered separately. Of particular concern to the committee is that if either House substantially amends the rules for holding the referendum on the alternative vote, the government may have to reconsider the date of the vote or run the risk of serious administrative difficulties which could undermine the outcome. The committee stresses that voters must understand what they are voting for and that recommendations by the Electoral Commission on the intelligibility of the referendum question should be implemented. The Committee also states that the government's failure to attempt to reach cross-party consensus on its boundary reform proposals adds fuel to the fire for those claiming the bill is being brought forward for partisan motives and may embolden future governments to do the same. The committee also questions why the public is not being offered a referendum on constituency boundary reform, which significantly affects how voters are represented in Parliament. Also, while the committee agrees that there may be a case for reducing the number of MPs, it says the Government has singularly failed to make it. The impact of boundary reforms on local politics appears to have been given little or no consideration and the committee expresses concern about the potential impact of the current proposals on the ability of MPs to fulfil their responsibilities to their constituents.

Book excerpt: On 3 May 2007, combined elections were held in Scotland, electing members to the Scottish Parliament and all 32 of Scotland's local councils. The number of spoilt ballots cast in these elections was unusually high, and difficulties with the electronic counting machines led to the count being suspended in some constituencies. The Electoral Commission engaged Ron Gould CM to conduct an independent assessment of the elections. This report examines the findings of the Gould Report and its recommendations, some of which have already been accepted in principle by the Scotland Office and by the Scottish Executive, including holding the Scottish Parliament and local government elections at different times and producing separate regional and constituency ballot papers for the Scottish Parliament elections. Evidence strongly suggests that there are deep problems with the way elections are administered, both in Scotland and across the UK, which, if left unaddressed, could again create difficulties in the future. Any changes to the way in which elections are carried out must be accompanied by rigorous research and testing; the absence of such research and testing was a major failing that led to the problems of 3 May. There were failings on the part of the Scotland Office, where lengthy delays disrupted election planning and led to weak contingency arrangements. The Electoral Commission did not do enough to warn of potential problems with the ballot. The use of e-counting has been subject to particular criticism. Although electronic counting may have the potential to produce results more quickly, in these elections it did not operate efficiently or transparently. Any future proposals must place the needs of the voter and the interests of transparency far above the limitations of any given technology.

Book excerpt: This report considers the Fixed-term Parliaments Bill which would remove the Prime Minister's power to call an election at the time of his choosing, and sets a five year fixed term, subject to the possibility of early dissolution following a vote by the House of Commons. It examines the key issues of the Bill's principals as well as the process by which it was brought forward. The Committee takes the view that the origins and content of the Bill owe more to short-term considerations than to a mature assessment of enduring constitutional principles or sustained public demand. In the view of the majority of the Committee, the shift from a five year maximum to five year norm would inconsistent with the Government's stated aim of making the legislature more accountable; with existing constitutional practice; and with the practice of the devolved institutions and the clear majority in international legislatures. However the Committee does accept that an elected government should have a full term in which to develop their policies and take their legislative programme through Parliament. It considers a four year term should be adopted for any fixed-term arrangement at Westminster. Potential date clashes with elections to the devolved institutions should also be avoided. Some form of safety valve which would allow for an early election in circumstances such as the government losing the confidence of the Commons or where a political or economic crisis has affected the country is also necessary. The report also makes several specific recommendations for amendments for the Bill.
