Book Criminal Law and the Man Problem

Download or read book Criminal Law and the Man Problem written by Ngaire Naffine and published by Bloomsbury Publishing. This book was released on 2019-04-04 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Men have always dominated the most basic precepts of the criminal legal world – its norms, its priorities and its character. Men have been the regulators and the regulated: the main subjects and objects of criminal law and by far the more dangerous sex. And yet men, as men, are still hardly talked about as the determining force within criminal law or in its exegesis. This book brings men into sharp focus, as the pervasively powerful interest group, whose wants and preoccupations have shaped the discipline. This constitutes the 'man problem' of criminal law. This new analysis probes the unacknowledged thinking of generations of influential legal men, which includes the psychological and legal techniques that have obscured the operation of bias, even to the legal experts themselves. It explains how men's interests have influenced the most cherished legal norms, especially the rules of human contact, which were designed to protect men from other men, while specifically securing lawful sexual access to at least one woman. The aim is to test the discipline's broadest commitments to civility, and its trajectory towards the final resolution, when men and women were declared to be equal and equivalent legal persons. In the process it exposes the morally and intellectually limiting consequences of male power.

Book Law Women Judges and the Gender Order

Download or read book Law Women Judges and the Gender Order written by Kcasey McLoughlin and published by Routledge. This book was released on 2021-11-18 with total page 359 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to understand how women judges are situated as legal knowers on the High Court of Australia by asking whether a near-equal gender balance on the High Court has disrupted the Court’s historically masculinist gender regime. This book examines how the High Court’s gender regime operates once there is more than one woman on the bench. It explores the following questions: How have the Court’s gender relations accommodated the presence women on the bench? How have the women themselves accommodated those pre-existing gender relations? How might legal judgments and reasoning change as a result of changing gender dynamics on the bench? To develop answers to these (and other) questions the book pursues a methodology that conceptualises the High Court as an institution with a particular gender regime shaped historically by the dominant gender order of the wider society. The intersection between the (gendered) individuals and the (gendered) institution in which they operate produces and reproduces that institution’s gender regime. Hence, the enquiry is not so much asking ‘have women judges made a difference?’ but rather is asking how should we understand women judges’ relationship with the law, a relationship that is shaped as much by the individual judge as by the institutional context in which they operate. Scholars, legal practitioners and researchers interested in judicial reasoning, gender diversity and the legal profession, gender and politics will be interested in this book because it breaks new ground as a case study of a Court’s gender regime at a particular time.

Book Beyond the Hijab Debates

Download or read book Beyond the Hijab Debates written by Tanja Dreher and published by Cambridge Scholars Publishing. This book was released on 2009-03-26 with total page 295 pages. Available in PDF, EPUB and Kindle. Book excerpt: Headscarves in schools. Ethnic gang rapists. Domestic violence in Indigenous communities. Polygamy. Sharia law. It seems that in public debates around the world, concerns about marginalised communities often revolve around issues of gender and women’s rights. Yet all too often, discussions about complex matters are reduced to simplistic debates such as “hijab: to ban or not to ban?” or “Muslim women: oppressed or liberated?”. This collection provides a space for in-depth analyses on the politics of gender, race and religion. As well as critical reflections on images and experiences of Muslim women, chapters also explore the relationships between gender, violence and protection, and offer innovative possibilities for intellectual and practical understandings at the intersection of gender, race and religion. Essential reading for scholars and students of gender and women’s studies, cultural studies, racial and ethnic studies, religious studies and an educated public interested in understanding the challenges and possibilities of tackling both racism and the oppression of women.

Now he’s got the wrong people breathing down his neck, and the only way out demands placing his trust in the unlikeliest of heroes: Duncan Rook, a gruff cop whose ethics are as solid as his body.
