Download or read book Law in Northern Ireland written by Brice Dickson and published by Bloomsbury Publishing. This book was released on 2023-06-30 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Download or read book Governing by Numbers written by Edward Page and published by Hart Publishing. This book was released on 2001-03 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Governing by Numbers is a jargon-free account of how delegated legislation - laws that do not pass through the full legislative scrutiny to which Acts of Parliament are subjected - is made. It is based on new research involving an analysis of nearly 30,000 pieces of delegated legislation; detailed investigation of 46 recent regulations based on in-depth interviews with those involved in developing, writing and scrutinising them and a major survey of nearly 400 interest groups. Delegated legislation is examined as a form of "everyday policy-making". It deals with important issues, from the level of welfare benefits to weapons exports, animal health and the prevention of air pollution, yet has been largely ignored in studies of the British political and administrative system. This book analyses the distinctive character of everyday policy making and the implications of how it works for our understanding of British democracy.

Download or read book Sanctions in EU Competition Law written by Michael Frese and published by Bloomsbury Publishing. This book was released on 2014-12-01 with total page 454 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the early decades of European integration the enforcement of EU competition law was highly centralised. Virtually all enforcement actions under Articles 101 and 102 TFEU were initiated by the European Commission. More recently the enforcement of EU competition law has become less centralised - many would say even decentralised. In 2004, essentially in an effort to increase enforcement capacity in the wake of EU enlargement, the involvement of Member State competition authorities was significantly reinforced by national authorities being given power to pursue infringements of EU competition law largely on the basis of their domestic enforcement regimes. This combination of decentralisation and enforcement autonomy raises questions about the relationship between EU law and national law, as well as about the costs of enforcement. This new book links these questions by analysing how competences in the area of sanctions are distributed between EU and national law, and how this influences the costs of enforcement. The author's conclusions, which highlight the economic implications of the choices made by competition authorities, courts and legislators, will be of use to all the above in further developing EU competition policy. The PhD thesis on which this book is based was declared runner-up in the 2013 Concurrences Awards.
