Book excerpt: L’opera – dopo una breve definizione tributaria dei redditi di lavoro dipendente prevista dal TUIR, a beneficio degli approfondimenti che seguiranno – è finalizzata a descrivere sotto il profilo fiscale i rapporti tra impresa e dipendente. La prima parte della trattazione riguarda i fringe benefits, ossia le remunerazioni in natura o, più in generale, le “utilità” che il datore di lavoro può riconoscere al dipendente a vario titolo e che si sostanziano, nei fatti, in remunerazioni aggiuntive rispetto a quella monetaria. Di queste, sono analizzate nel dettaglio anche le regole per la tassazione nell’ambito del reddito di lavoro dipendente, avendo particolare riguardo alle “attribuzioni” esenti o che concorrono solo parzialmente alla base imponibile del lavoratore (si pensi alle polizze assicurative aziendali ed ai contributi sanitari), segnalando le più recenti posizioni di prassi dell’amministrazione finanziaria e di giurisprudenza, al fine di fornire anche un aggiornato ed autorevole orientamento interpretativo sui vari istituti. La seconda parte viene dedicata ai rimborsi spese e alla gestione delle trasferte dei soggetti impiegati nell’attività, con riferimento specialmente alle spese di vitto e alloggio e a quelle di trasporto. Circa queste ultime, vengono trattati anche gli aspetti di convenienza – sia economica che fiscale – facendo gli opportuni confronti tra spostamenti del dipendente con mezzo proprio e con vettura di proprietà aziendale. Valore aggiunto all’opera è il gran numero di esempi di calcolo e casi svolti – adeguati con le nuove aliquote IVA al 22% decorrenti dal 1° ottobre 2013 – che intervallano l’esposizione, rendendo il volume uno strumento di assoluta utilità pratica. Questa seconda edizione – aggiornata con le novità di prassi intervenute nel corso del 2013, fra cui si segnalano la risoluzione n. 48/E del 8 luglio 2013 (riduzione dell’imposta estera sul reddito prodotto all’estero) e la circolare INPS n. 17 del 5 febbraio 2013 (determinazione per l’anno 2013 delle retribuzioni convenzionali dei lavoratori all’estero) – tiene conto del D.L. n. 102 del 31 agosto 2013, che riduce il limite massimo di fruizione per la detraibilità dei premi di assicurazioni sulla vita e contro gli infortuni. The assessment has been unprecedented. Over a 14-month period, the UNEP team examined more than 200 locations, surveyed 122 kilometres of pipeline rights of way, reviewed more than 5,000 medical records and engaged over 23,000 people at local community meetings. The environmental restoration of Ogoniland could prove to be the world's most wide-ranging and long term oil clean-up exercise ever undertaken if contaminated drinking water, land, creeks and important ecosystems such as mangroves are to be brought back to full, productive health. The report key findings are alarming both in terms of human health protection and environmental protection: some areas, which appear unaffected at the surface, are in reality severely contaminated underground; at least 10 Ogoni communities where drinking contaminated water; control and maintenance of oilfield infrastructure in Ogoniland has been and remains inadequate; the impact of oil on mangrove vegetation has been disastrous. The report recommends direct actions in order to address the Niger Delta contamination by oil and warns that the restoration of the area could take up years.
