Book excerpt: This book deals with the history and future of the concept of ‘world peace through law’ (WPTL), which advocates replacing the use of international force with the global rule of law. WPTL calls for replacing war with the global rule of law by arms reductions, including the abolition of nuclear weapons, global alternative dispute resolution mechanisms, and various enforcement mechanisms. This book sets forth a three-part proposal: 1) arms reductions – primarily the abolition of nuclear weapons, with necessarily concomitant reductions in conventional forces; 2) a four-stage system of global alternative dispute resolution (ADR), utilizing both law and equity; 3) adequate enforcement mechanisms, including a UN Peace Force. The core of this proposal is alternative dispute resolution mechanisms—international ADR. International ADR would consist of a four-stage process of compulsory negotiation, compulsory mediation, compulsory arbitration., and compulsory adjudication by the World Court. The fundamental proposition of this book is that the use of alternatives to war, global ADR, is the ultimate solution to the problem of peace. The full implementation of WPTL will entail a vast array of progressive initiatives on many fronts, including abolition of nuclear weapons, with the global rule of law being the capstone to all of these developments. This book will be of great interest to students of peace studies, arms control, international law, and world politics.

The US planned the replacement of mutually assured destruction by mutually assured security. A global astrodome was to protect a nuclear disarmed world. The Franco-German special relationship in European affairs had to be amended by a US-SU special relationship to replace classic bloc politics. The Reagan Administration planned a global zero agenda, a joint development of a global protective system and a creation of a Common House of Europe. In brief, the superpowers prepared ‘the velvet revolution’ that eliminated the Cold War structures. Neither containment nor convergence offers a valid explanation of the Cold War endgame. Co-creation is the key to decipher the end of the Cold War. NATO Europe challenged the transformation of bipolarity. The European NWS resisted to a multilateralization of strategic arms control. In Europe the classic Cold War thinking survived the fall of the Iron Curtain. European conservatism contributed to the geopolitical catastrophe of the first order: the downfall of the Soviet Union. The Reagan Administration developed a Grand Strategy to end the Cold War. The US-SU co-creation of an astrodome was meant to ease a global zero agenda. A global collective security structure under the United Nations was to replace deterrence. The superpower project collapsed due to the penetration of US decision-making by NATO Allies. The European NWS totally objected to a multilateralization of strategic arms control to preserve their relative position in the international system.

Based on detailed analysis of the facts and law, Professor Moxley shows that the United States’ arguments that uses of nuclear weapons, including low-yield nuclear weapons, could be lawful do not withstand analysis. Moxley opens by examining established rules of international law governing the use of nuclear weapons, first analyzing this body of law based on the United States’ own statements of the matter and then extending the analysis to include requirements of international law that the United States overlooks in its assessment of the lawfulness of potential nuclear weapons uses. He then develops in detail the known facts as to nuclear weapons and their consequences and U.S. policies and plans concerning such matters. He describes the risks of deterrence and the existential nature of the effects of nuclear war on human life and civilization. He proceeds to pull it all together, applying the law to the facts and demonstrating that known nuclear weapons effects cannot comply with such legal requirements as those of distinction, proportionality, necessity, precaution, the corollary requirement of controllability, and the law of reprisal. Moxley shows that, when the United States goes to apply international law to potential nuclear weapons uses, it distorts the law as it has itself articulated it, overlooks law in such areas as causation, risk analysis, mens rea, and per se rules, and disregards known risks as to nuclear weapons effects, including radioactive fallout, nuclear winter, electromagnetic pulses, and potential escalation. He then shows that the policy of deterrence is unlawful because the use of such weapons would be unlawful. Moxley urges that the United States and other nuclear weapons States take heed of the requirements of international law as to nuclear weapons threat and use. He argues that law can be a positive force in society’s addressing existential risks posed by nuclear weapons and the policy of nuclear deterrence.

Nuclear weapons have served the dual purpose of being part of NATO military planning as well as being central to the Alliance's deterrence strategy. For over 4 decades, NATO allies sought to find conventional and nuclear forces, doctrines, and agreed strategies that linked the defense of Europe to that of the United States. Still, in light of the evolving security situation, the Alliance must now consider the role and future of tactical or non-strategic nuclear weapons (NSNWs). Two clear conclusions emerge from this analysis. First, in the more than 2 decades since the end of the Cold War, the problem itself -- that is, the question of what to do with weapons designed in a previous century for the possibility of a World War III against a military alliance that no longer exists -- is understudied, both inside and outside of government. Tactical weapons, although less awesome than their strategic siblings, carry significant security and political risks, and they have not received the attention that is commensurate to their importance. Second, it is clear that whatever the future of these arms, the status quo is unacceptable. It is past the time for NATO to make more resolute decisions, find a coherent strategy, and formulate more definite plans about its nuclear status. Consequently, decisions about the role of nuclear weapons within the Alliance and the associated supporting analysis are fundamental to the future identity of NATO. At the Lisbon Summit in Portugal in November 2010, the Alliance agreed to conduct the Deterrence and Defense Posture Review (DDPR). This effort is designed to answer these difficult questions prior to the upcoming NATO Summit in May 2012. The United States and its closest allies must define future threats and, in doing so, clarify NATO's identity, purpose, and corresponding force requirements. Book excerpt: The New START Treaty, signed by presidents Barack Obama and Dmitry Medvedev in April 2010, was an important achievement. A follow-on to the 1991 START treaty, New START commits both countries to substantial reductions in their nuclear arsenals. Pending ratification in the Russian Duma and U.S. Senate, New START limits both countries to 1,550 deployed strategic nuclear warheads--far below the Cold War peak of 31,000 strategic and tactical nuclear weapons in the United States alone. Moreover, the New START treaty furthers Obama's goal of "resetting" U.S.-Russia relations. In just the past two years, the former adversaries also finalized an agreement on plutonium disposition, imposed UN sanctions against Iran in reaction to its nuclear program, and enhanced security for non-deployed tactical nuclear weapons. Despite these signs of progress, it is unwise to be complacent. Even after the implementation of the New START Treaty, Obama's goal of a "world free of nuclear weapons" will remain elusive--the United States and Russia will still command enough nuclear weapons to annihilate each other several times over. In this Council Special Report, Fellow for Conflict Prevention Micah Zenko argues that reducing nuclear weapons stockpiles even further than New START treaty levels--to one thousand warheads, including tactical nuclear weapons--would be both strategically and politically advantageous. It would decrease the risk of nuclear weapons theft and nuclear attack and increase international political support for future U.S. initiatives to reduce or control nuclear warheads, all while maintaining a credible nuclear deterrent. To achieve such a significant reduction in a follow-on to the New START treaty, the United States and Russia would need to reach agreement on three long-standing and contentious issues. Tactical nuclear weapons deployments will be the most difficult of these challenges, Zenko writes, since Russia has a much larger arsenal of tactical nuclear weapons than does the United States and will therefore bear the brunt of the tactical nuclear weapons cuts. Missile defense is the second obstacle toward further significant nuclear reductions. Much work remains to secure Moscow's cooperation on--or acceptance of--the project. Finally, the United States and Russia must reach agreement on the use of nuclear vehicles for conventional weapons. It is difficult to overstate the potential danger if either country mistook a conventional missile for a nuclear one. Toward Deeper Reductions in U.S. and Russian Nuclear Weapons makes a thoughtful contribution to the discussion on how to build a stable future with far fewer nuclear weapons. With ongoing debate over the New START treaty in the Senate, this CSR serves as a reminder that there is more work to be done.
