Book excerpt: Economists and policy makers have long recognized that innovators must be able to appropriate a reasonable portion of the social benefits of their innovations if innovation is to be suitably rewarded and encouraged. However, this paper identifies a number of specific fact patterns under which the current U.S. patent system allows patent holders to capture private rewards that exceed their social contributions. Such excessive patentee rewards are socially costly, since they raise the deadweight loss associated with the patent system and discourage innovation by others. Economic efficiency is promoted if rewards to patent holders are aligned with and do not exceed their social contributions. This paper analyzes two major reforms to the patent system designed to spur innovation by better aligning the rewards and contributions of patent holders: establishing an independent invention defense in patent infringement cases, and strengthening the procedures by which patents are re-examined after they are issued. Three additional reforms relating to patent litigation are also studied: limiting the use of injunctions, clarifying the way in which quot;reasonable royaltiesquot; are calculated, and narrowing the definition of quot;willful infringement.quot.

In this volume, Clifford Zinnes argues that a donor's intrinsic informational limitations on the local context as well as inability to control the progress of interventions mean that lack of success is not rooting in insufficient funding but in maladapted institution designs of interventions that don't foster local ownership. He indentifies and assesses a newly emerging class of foreign aid delivery that promises to overcome these obstacles. The approach is based on "prospective inter-jurisdictional competition" (PIJC). Beneficiary groups—often local-level governments, supported by their private sector and civil society—act as teams and compete against each other under explicit predefined rules and objectives to design and implement interventions under their own aegis to achieve the highest quantitatively measured performance, either relative to others ("tournaments") or against a preset benchmark ("certification"). Teams that cooperate internally are the likeliest to win the rewards, which, aside from the longer run benefits of the intervention itself, might include more substantive financial or technical assitance from the sponsor. Since only groups serious about reforming choose to play, Zinnes says the incentives generated by the ensuing "race-to-the-top" competitiion create local ownership, encouraging recipients to draw on their own knowledge. Moreover, since all teams that compete—and not just those who "win" donor rewards—benefit from their own reform efforts, he argues that this approach can leverage aid resources more than a conventional bilateral aid agreement. Zinnes presents a dozen recent applications of the approach, including those sponsored by the World Bank, USAID, the United Nations, the Ford Foundation, and others. This book examines one of the most ambitious attempts to use monetary incentives in the criminal justice system: New York City's $8.25 million Speedy Disposition Program (SDP). New York City officials introduced SDP as an incentive scheme to encourage the city's six District Attorneys to accelerate the disposition of those criminal cases that most contributed to the city's chronic jail overcrowding problem. Substantial financial rewards would be given to those DAs' offices that managed to dispose of their oldest felony cases, those cases involving "long-term detainees." The implementation of SDP in New York City — and the responses of the city's district attorneys to it — provides fascinating tales that teach much about innovation in criminal justice, about new approaches to court reform and delay reduction, and more generally, about the uses of monetary incentives as policy tools. Further, the program provides a rich source for analysis of the considerations that should go into the design of incentive programs, and into the contextual factors that argue for their applicability in other areas.

Throughout the advanced industrialized nations, welfare reforms incorporate work-oriented measures such as financial incentives, insertion contracts, training, and requirements to search for and accept jobs. The evidence in this volume suggests that while the details may vary, welfare reforms in France and the United States have more in common than is often acknowledged. Welfare Reform provides an in-depth analysis of the development and structure of modern welfare programs and how they function. The dynamics of welfare reform are illuminated by focusing on two programs: the Revenu Minimum d'Insertion in France and Temporary Assistance for Needy Families in the United States. Taking various analytic approaches, contributors examine the relations between poverty and work, how U.S. and French models of income support have been transformed in recent times, the relative impacts of economic growth and policy reforms on rates of welfare participation, and what happens to recipients who leave the welfare rolls. Book excerpt: This open access book presents an actor-centered study on Europeanization, based on the assumption that EU-driven reforms are highly dependent on the behavior and interests of the key domestic actors. Whether or not a state pursues a European and democratic agenda depends on domestic lawmakers. Further, political elites are pre-eminent in deciding on the nature, form and content of any law, and on the extent to which the rule of law is actually enforced. Elites can overcome structural or institutional barriers that stand in the way of achieving their goals. The empirical study on Romania presented here lends this observation a more profound meaning: it shows how, in contexts where high level corruption is the norm rather than the exception, self-serving political elites cannot be expected to genuinely commit to adopting sound anti-corruption reform. The book is an inquiry into the motivations that drive legislators to make particular decisions, but also into the structural characteristics and dynamics of the elite that invite a selfish rather than responsible and responsive behaviour.
