Book excerpt: Abstract: This policy analysis examined the purpose, goals, implementation, and impacts of mandatory minimum sentences as outlined in the Anti-Drug Abuse Act of 1986. After reviewing government documents and scholarly literature that address the policy, a modified version of David Gil's 1992 framework was used to conduct the analysis. Significant findings include the misalignment between the policy's objectives and the factual American condition regarding drugs and drug-related crime. Since implementation, people and communities of color have been disproportionately disadvantaged by this policy. New social problems, such as prison overcrowding, have resulted from lengthy prison sentences. From this analysis, social workers can learn the importance of educating the public about drug use and related systemic issues. Social workers can use this information to advocate for relevant and effective policies to respond to problematic drug use in America from a public health, rather than criminal justice, perspective.

Book excerpt: The Anti-Drug Abuse Act of 1986 is often viewed as a prominent piece of legislation that served to criminalize a significant portion of black and brown communities within the larger War on Drugs staged by the US government. However, my research seeks to contextualize the Act’s role in institutionally reinforcing new forms of white supremacy through examining how the policy its surrounding political narratives relate to the pre-existing ways in which white supremacy in US society had already functioned. Through examining the contents of the Act itself alongside its accompanying federal handbook, the paper assesses how the choice of targeting crack cocaine relates to the federal government’s efforts to demonize and imprison members of the black community as well as observes the effects of legally codified patriarchal thought. Then, through observing the remarks that were uncritically repeated within the New York Times and Wall Street Journal by Ronald Reagan, Edwin Meese III, and several other prominent political figures, this project examines, not only how their alleged justifications for enacting their drug crusade differed from the actual studied results, but how their remarks served the double purpose of reifying pre-existing forms of white supremacist and capitalist oppression. Finally, this paper examines the subsequent effects of the War on Drugs through tracing the deep-seated effects of “color-blind” racist ideology. Ultimately, this paper concludes that the US has always been and continues to be a white supremacist society that relies upon a series of policing, mass media, and economic systems to maintain the oppressive status quo in which black and brown peoples are continually dehumanized, imprisoned, and exploited by the ruling capitalist class.

Book excerpt: The study of racial disparity in the criminal justice system has been widely recognized as a complex and sensitive issue that has indelibly influenced sentencing outcomes for Black men. With the passage of the Anti-Drug Abuse Act of 1986, new Federal mandatory minimum guidelines recognized the 100:1 crack-powder cocaine sentencing disparity which set into motion an era of aggressive policies. This research analyzes the effects of mandatory minimum sentencing laws embedded in the ADAA of 1986, while establishing the inconsistencies with aggressive policing and the ramifications associated with racial discrimination. Critical Race Theory is used as an analytic, explanatory, and conceptual instrument in the study, while providing a necessary understanding of the framework used in identifying and examining the differences between the sentencing disparity in relation to socioeconomic status and race. The analysis of this policy introduces previous and current research to examine the power structures and systemic oppression that perpetuate racial inequities in order to identify and develop strategies for action and change. The preponderance of evidence suggests that the association of race and sentencing outcomes continues to operate through policies and practices inundated within social systems, structures, and institutions that systematically reflect and produce racial inequalities.
