Book excerpt: Pursuant to a congressional request, GAO reviewed the: (1) laws and policies governing recreation concession operations on federal lands; (2) total number and types of concession agreements; (3) total return to the government from concession operations; and (4) federal recreation resources management practices of the National Park Service, Bureau of Land Management, U.S. Fish and Wildlife Service, Bureau of Reclamation, Forest Service, and Army Corps of Engineers. GAO found that: (1) no single law authorizing concession operations existed; (2) none of the agencies maintained a complete database identifying the number and types of concession agreements; (3) the agencies could not determine total compensation to the federal government for the use of federal recreational resources, due to incomplete financial data and unreported nonfee considerations; (4) the agencies identified 11 different laws governing concession agreements and operations, many of which were agency-specific and allowed for broad discretion in establishing policies; (5) complete financial data were available for only 60 percent of over 9,000 concession agreements reported by the agencies; (6) some agencies permitted field offices to accept such nonfee compensation as capital improvements from concessioners, but the offices generally did not report such agreements to headquarters; (7) from those concessioners who reported complete financial data in 1989, the federal government received about $35 million in concession fees, with gross concession revenues of about $1.4 million, representing an average return to the government of about 2 percent; and (8) various fee approaches by the six agencies resulted in concessioners paying different fees to operate similar activities.

Book excerpt: Pursuant to a congressional request, GAO reviewed the federal government's oversight of concessioners operating on federal recreation lands under short-term agreements, focusing on the government's policy and practices for: (1) evaluating short-term concessioners' performance; (2) ensuring that short-term concessioners comply with federal, state, and local health and safety laws and regulations; (3) ensuring that short-term concessioners' prices are reasonable; and (4) establishing fees for short-term use of federal land. GAO found that: (1) short-term concessioners operating on federal lands are not treated consistently by the four agencies that manage the lands because of varying policies and practices; (2) not all short-term concessioners are subject to annual performance evaluations; (3) some required performance evaluations are not done due to funding problems and logistics and may not be documented; (4) National Park Service concessioners operate under three different types of agreements and performance evaluations are only required for permit and limited-permit holders; (5) most short-term concessioners do not receive health and safety inspections although they are required to comply with all applicable laws and regulations; (6) the Park Service is the only agency that requires documentation when other qualified agencies perform health and safety inspections, but it does not require inspection of its commercial-use license holders; (7) the agencies cite the lack of resources, responsibility, and reported complaints as the reasons for not doing health and safety inspections; (8) price reviews are generally not required and the agencies rely on market forces to regulate prices; and (9) short-term concessioners' fees vary by agency due to different fee criteria.

Book excerpt: Pursuant to a congressional request, GAO examined six federal agencies' oversight of concessioners providing recreation services under long-term agreements on federal lands, focusing on the: (1) concessioners' overall performance; (2) concessioners' compliance with federal, state, and local health and safety standards; and (3) reasonableness of the prices that concessioners charge the public for services. GAO found that: (1) concessioners hold about 1,500 long-term agreements to provide a range of recreation services on land managed by the National Park Service, the Bureau of Land Management, the U.S. Fish and Wildlife Service, the Bureau of Reclamation, the Forest Service, or the Army Corps of Engineers; (2) a review of 12 of the top 100 revenue-producing concessioners indicated that the agencies rated all of the concessioners as satisfactory in their overall performance, satisfactory on health and safety matters, and reasonable in terms of the prices that they charged; (3) agencies rated 47 of 50 randomly selected concessioners as satisfactory in their overall performance, 2 as needing improvement, and 1 as unsatisfactory; (4) the responsible agency subsequently suspended the unsatisfactory concessioner, since it did not meet drinking water quality, food service, or electrical and fire safety standards; (5) the agencies concluded that 43 of the 50 concessioners charged reasonable prices, and did not review the other 7 concessioners' prices, since they did not request an increase; and (6) the federal agencies used the results of inspections conducted by state and local government agencies in evaluating concessioners, but were not always aware when state and local agencies did not perform the inspections.

GAO noted that: (1) agency concessions policies and practices vary widely because they are based on at least 11 different laws; (2) many of the laws are agency specific and give the agency broad discretion in establishing concession terms, conditions, and associated fees; (3) 3 agencies grant a preferential right to contract renewal to most of their concessioners, while the other 3 agencies do not grant preferential rights to any concessioner; (4) concession contracts should be opened to more competition, since concession fees yield on average a return of 2.4 percent of gross concession revenues; (5) the National Park Service receives some noncash compensation, such as concessioners' improvements to or maintenance of Park Service facilities; (6) the Forest Service does not currently receive fair market value from ski operators; (7) the proposed legislation is consistent with past GAO findings and would establish common concessions policies on such issues as possessory interest; (8) extinguishing possessory interest could reduce concessions fees and increase the Park Service's maintenance burden; (9) 3 of the proposed bills increase competition, limit the preferential right of renewal, improve government returns, and allow the agencies to retain the fees; and (10) one bill would establish an new simpler fee system for ski areas on Forest Service lands, but it does not require the fees to reflect fair market value.
