Within the vast field of adjudication, the book addresses one of the most traditional sets of procedures, namely, the exercise of public powers affecting property rights. Following the method adopted in the CoCEAL project, this volume takes the fundamentals of expropriation in a given legal order as its starting point and examines various cases. The main requirements for property rights deprivations and restrictions are presented through national reports and discussed through hypotheticals, while the comparative analysis focuses on procedural propriety and fairness. This book is divided into three parts. The first part introduces the project and the topic. The second part covers the legal systems chosen for this study. The third goes on to present a synchronic comparison across systems, highlighting the relationship between shared and distinctive traits, with a view to the way supranational and international rules increasingly supplement municipal regimes. The concluding chapter discusses the current regime on public regulation of property in contemporary administrative systems.

Final responsibility for the overall regulatory framework, and the protection of the public finances remains with the Treasury, and the Chancellor of the Exchequer. An Independent Commission on Banking has also been established to consider what steps should be taken to deal with systemically important banks, alongside the question of whether and how competition in the banking sector should be improved. The Commission proposes: that the most systemically important banks hold additional capital to the Basel III minimum, to make them better at absorbing losses and less likely to fail; 'bail-in' instead of bail-out - so that private investors, not taxpayers, bear the losses if things do go wrong; and putting a ring-fence around high street banking to make it safer and to make it easier to allow a bank to fail without disrupting crucial banking services.

Although forest losses are alarming, broader trends are bending in the direction of forest recovery. In this book, Brent Sohngen and Douglas Southgate address the long-term recovery of forests in Latin America. The authors synthesize trends in demography, agricultural development, and technological change, and argue that slower population growth and increasing crop and tree yields—in conjunction with protecting local ownership of natural resources—have encouraged forest transition. This book explores how market forces, ownership arrangements, and the enforcement of property rights have influenced this shift from net deforestation to net afforestation. Forest transitions have happened before, such as the recovery of tree-covered habitats in Europe and the United States. Signs of a similar transformation in land use are now present in Latin America. Ending deforestation requires a strengthening of forest dwellers' property rights while ensuring that biodiversity conservation is no longer treated as a value-less externality. The resulting forest landscape, actively managed for ecosystem services, will be more resilient, as is needed to overcome climate change.
