The outside partner may be a private organization or a government. The interest of the local partner may be production of income from the forest, security of access to land, increased labor or small business opportunities, protection of traditionally valued resources, or other values. The interest of the outside partner may be similarly varied, from securing access to forest products, to obtaining the cooperation of the local community in the partner's resource use, to securing a source of labor, to alleviation of rural poverty, to production of environmental services and management of risks. Establishing arrangements that effectively deliver sustainable forest management and benefit local communities is a challenge because of the range of participants, objectives, and scales of partnerships and benefit-sharing arrangements. This study uses an evidence-based approach to provide insights into developing and maintaining collaborative arrangements in the forest sector. It aims to inform discussions and approaches to forest partnership and benefit-sharing arrangements. It also offers guidance on how to implement key factors that influence contract-based forest partnerships and benefit-sharing arrangements.

In a growing number of countries legislation is being introduced to ensure that local partners share in the benefits of forest operations and participate as active stakeholders in the sustainable use of forest resources. Private sector investment in the forest sector is increasing as well. For businesses in an expanding range of investment settings, establishing and maintaining positive working relationships with local communities is an essential part of gaining access to natural resources, local skills and labor. Afforestation and reforestation activities and programs to reduce greenhouse gas emissions from deforestation and forest degradation (REDD), including sustainable forest management (SFM) and forest restoration, seek to increase forest carbon sequestration, and their success or failure will rely in many respects on the effective cooperation of forest dependent people. These developments are giving partnerships and benefit-sharing arrangements between local and outside partners greater prominence than they have generally had in the past. The significance of these collaborative arrangements is increasing whether the local partner is a community, a user or producer association, or a group of individual landholders, and whether the outside partner is a private firm, a government agency, or a nongovernmental or civil society organization. The arrangements vary widely in purpose as well for the respective partners. Local partners may be interested in employment and income generating opportunities, in the security of their access to forest land, in the protection of resources that have traditional or other values, or in capitalizing on small business opportunities. Outside partners may be interested in gaining and securing access to forest products, in obtaining the cooperation of local communities in how forest resources are used, in alleviating rural poverty, or in managing risks and ensuring the provision of environmental services.

Book excerpt: The issue of REDD+ benefit sharing has captured the attention of policymakers and local communities because the success of REDD+ will depend greatly on the design and implementation of its benefit?sharing mechanism. Despite a large body of literature on potential benefit?sharing mechanisms for REDD+, the field has lacked global comparative analyses of national REDD+ policies and of the political?economic influences that can either enable or impede the mechanisms. Similarly, relatively few studies have investigated the political?economic principles underlying existing benefit?sharing policies and approaches. This working paper builds on a study of REDD+ policies in 13 countries to provide a global overview and up?to?date profile of benefit?sharing mechanisms for REDD+ and of the political?economic factors affecting their design and setting. Five types of benefit?sharing models relevant to REDD+ and natural resource management are used to create an organising framework for identifying what does and does not work and to examine the structure of rights under REDD+. The authors also consider the mechanisms in light of five prominent discourses on the question of who should benefit from REDD+ and, by viewing REDD+ through a 3E (effectiveness, efficiency, equity) lens, map out some of the associated risks for REDD+ outcomes. Existing benefit?sharing models and REDD+ projects have generated initial lessons for building REDD+ benefit?sharing mechanisms. However, the relevant policies in the 13 countries studied could lead to carbon ineffectiveness, cost inefficiency and inequity because of weak linkages to performance or results, unclear tenure and carbon rights, under?representation of certain actors, technical and financial issues related to the scope and scale of REDD+, potential elite capture and the possible negative side effects of the decentralisation of authority. Furthermore, the enabling factors for achieving 3E benefit?sharing mechanisms are largely absent from the study countries. Whether REDD+ can catalyse the necessary changes will depend in part on how the costs and benefits of REDD+ are shared, and whether the benefits are sufficient to affect a shift in entrenched behaviour and policies at all levels of government. The successful design and implementation of benefit?sharing mechanisms – and hence the legitimacy and acceptance of REDD+ – depend on having clear objectives, procedural equity and an inclusive process and on engaging in a rigorous analysis of the options for benefit sharing and their potential effects on beneficiaries and climate mitigation efforts.

The aggregate gross annual value of these smallholder producers approaches US$1.3 trillion. Adding value to that production, through financial investment, will be key to delivering the Sustainable Development Goals (SDGs). Therefore, access to finance is an important issue. The Forest and Farm Facility (FFF) commissioned this scoping paper to assess what might be done to improve access to finance. Organisation of forest and farm producers allows finance to be channelled toward valueadded investments. But the motivation to form forest and farm producer organisations (FFPOs) varies with context, from the desire to secure resource rights for Indigenous peoples in the forest core, to the desire to strengthen economic scale efficiencies in periurban forest product processing industries. The scale and type of finance needs vary and span enabling investments (grants or concessional loans)through to asset investments (market-rate capital that requires a return). Access to finance for FFPOs requires tailored approaches. For FFPOs, enabling investments in four key areas are needed to create the conditions and necessary track record to attract asset investment: (i) secure commercial rights; (ii) strong organisation for scale; (iii) appropriate technical extension; and (iv) fair market access and business incubation. Enabling investments of this sort make FFPO businesses bankable and affords them access to finance.

The research also examines social and cultural influences which impact on cultural harvesting and gender relations in the commune and households, particularly in regards to local rights and roles in harvesting the products. The results indicate that benefits from collecting non-timber forest products after introduction of the benefit sharing mechanism were insignificant when compared with before its introduction. Furthermore, development activities under the benefit sharing mechanism did not have any impact on local people, in terms of diversification of livelihood strategies, nor did it increase household income. Women, in particular, faced limitations in participating in the benefit sharing mechanism's program, as a result of strong customary laws within their ethnic group. However, the benefit sharing mechanism did increase women's knowledge on equal rights and roles in access to and control over forest resources, and their sense of responsibility in forest management and conservation"--Back cover.

Most of the CBD's specific ABS obligations, however, relate to the other side of the equation-benefit sharing. This book considers the full range of ABS obligations, and how existing tools in user countries' national law can be used to achieve the CBD's third objective. It examines the laws of those user countries which have either declared that their ABS obligations are satisfied by existing national law, or have begun legislative development; the requirements, weaknesses and gaps in achieving benefit-sharing objectives; and the ways in which new or existing legal tools can be applied to these requirements.
