While the World Trade Organization has taken to incentivizing sustainable development, international investment law and arbitration are only catching up. Given the international efforts in recognizing sustainable development as an important national and international goal, it is important to propose legal solutions to incentivize sustainable development for foreign investors. At an international level, technical assistance for host states, and benefit schemes for investors who contribute to sustainable development through the adoption of internationally accepted principles and corporate social responsibility (CSR) have gained ground. However, sustainable development rarely finds its place in the current design of most international investment agreements (IIAs). This Article revisits the International Law Association “New Delhi Declaration of Principles of International Law Relating to Sustainable Development” to formulate concrete legal solutions for introducing sustainable development not only as a binding obligation for investors but also as an incentive to improve sustainability through self-monitoring rather than national or international enforcement.

Today, more than one-third of world trade takes place in the form of intrafirm transactions—that is, trade among the various parts of the same corporate network spread across borders—and the bulk of technology is transferred within the confines of integrated international production systems. This means that FDI and the operations of multinational corporations have become central to the world economy at large. Nowhere is this more important than for developing countries. But as Theodore Moran argues in this new volume, FDI is not a single phenomenon. FDI has such different impacts in the extractive sector, infrastructure, manufacturing and assembly, and services—and presents such distinctive policy challenges—that each broad category of FDI must be treated on its own terms. One avenue to success is the harnessing of foreign direct investment (FDI) in the “nontraditional” forms of the high-technology and service sectors, where an educated workforce is essential and the spillover effects to other sectors are potentially very beneficial. In this book, Roy Nelson compares efforts in three Latin American countries—Brazil, Chile, and Costa Rica—to attract nontraditional FDI and analyzes the reasons for their relative success or failure. As a further comparison, he uses the successes of FDI promotion in Ireland and Singapore to help refine the analysis. His study shows that two factors, in particular, are critical. First is the government’s autonomy from special interest groups, both domestic and foreign, arising from the level of political security enjoyed by government leaders. The second factor is the government’s ability to learn about prospective investors and the inducements that are most important to them—what he calls “transnational learning capacity.” Nelson draws lessons from his analysis for how governments might develop more effective strategies for attracting nontraditional FDI.
