Book excerpt: This report is concerned exclusively with the Gomery Commission's second mandate: to make recommendations, based on the factual findings of its first report, on a series of issues such as government transparency & accountability, the relationship between public servants and politicians, and the responsibilities that should be assigned to Parliament & parliamentarians. Part one outlines the reforms introduced by the federal government since the Commission was established in February 2004 and the suggestions the Commission heard from Canadians about what they felt should be done about accountability & transparency in government and other issues considered in the first report. Part two has five sections covering accountability issues, including the fundamental bases for the responsibilities & accountabilities of Ministers & senior public servants, the capacity of Parliament to hold the government to account, and the roles of the Prime Minister, Ministers, exempt staff, the Privy Council Office, and the Clerk of the Privy Council. Part three deals with more specific issues such as the future management of advertising & sponsorship activities as well as lobbying. It assesses measures to improve transparency, including legislative initiatives pertaining to information access, whistleblowing, sanctions related to failure to fulfil financial administration obligations, appointments to Crown corporations, and internal audits. Part four contains the Commission's consolidated recommendations which are also found throughout the report. The recommendations are designed to rebalance the relationship between Parliament & government, better assign responsibility, and strengthen accountability in the public interest.

Book Life Without Lawyers Restoring Responsibility in America

Download or read book Life Without Lawyers Restoring Responsibility in America written by Philip K. Howard and published by W. W. Norton & Company. This book was released on 2010-02-01 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: How to restore the can-do spirit that made America great, from the author of the best-selling The Death of Common Sense. Americans are losing the freedom to make sense of daily choices—teachers can’t maintain order in the classroom, managers are trained to avoid candor, schools ban tag, and companies plaster inane warnings on everything: “Remove Baby Before Folding Stroller.” Philip K. Howard’s urgent argument is full of examples, often darkly humorous. He describes the historical and cultural forces that led to this mess and lays out the basic shift in approach needed to fix it. Today we are flooded with legal threats that prevent us from taking responsibility. We must rebuild boundaries of law that protect an open field of freedom. The voices here will ring true to every reader. The analysis is powerful, and the solution unavoidable. What’s at stake, Howard explains in this seminal book, is the vitality of American culture.

Book Just Culture

Download or read book Just Culture written by Sidney Dekker and published by CRC Press. This book was released on 2018-09-07 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: A just culture is a culture of trust, learning and accountability. It is particularly important when an incident has occurred; when something has gone wrong. How do you respond to the people involved? What do you do to minimize the negative impact, and maximize learning? This third edition of Sidney Dekker’s extremely successful Just Culture offers new material on restorative justice and ideas about why your people may be breaking rules. Supported by extensive case material, you will learn about safety reporting and honest disclosure, about retributive just culture and about the criminalization of human error. Some suspect a just culture means letting people off the hook. Yet they believe they need to remain able to hold people accountable for undesirable performance. In this new edition, Dekker asks you to look at 'accountability' in different ways. One is by asking which rule was broken, who did it, whether that behavior crossed some line, and what the appropriate consequences should be. In this retributive sense, an 'account' is something you get people to pay, or settle. But who will draw that line? And is the process fair? Another way to approach accountability after an incident is to ask who was hurt. To ask what their needs are. And to explore whose obligation it is to meet those needs. People involved in causing the incident may well want to participate in meeting those needs. In this restorative sense, an 'account' is something you get people to tell, and others to listen to. Learn to look at accountability in different ways and your impact on restoring trust, learning and a sense of humanity in your organization could be enormous.

Book Corruption in a Global Context

Download or read book Corruption in a Global Context written by Melchior Powell and published by Routledge. This book was released on 2019-11-12 with total page 504 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an important survey of the causes and current state of corruption across a range of nations and regions. Delving into the diverse ways in which corruption is being combatted, the book explores and describes efforts to inculcate principles of ethical conduct in citizens, private sector actors and public sector personnel and institutions. Corruption is a global condition that effects every type of government, at every level, and has bewitched scholars of governance from ancient times to the present day. The book brings together chapters on a range of state and regional corruption experiences, framing them in terms of efforts to enhance ethical conduct and achieve integrity in government practices and operations. In addition, the book addresses and analyses the theoretical and practical bases of ethics that form the background and historical precepts of efforts to create integrity in government practices, and finally assesses recent international efforts to address corruption on an international scale. This book will be perfect for researchers and upper level students of public administration, comparative government, international development, criminal justice, and corruption.

This book was released on 2006 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the second volume of papers written for the Gomery Commission research program, which at its most general level examined how Parliament relates to the federal government & public servants, and vice versa; how best to promote transparency in government; and the role of key political & administrative actors in government. The first paper presents the constitutional argument for bureaucratic independence and its implication for public service accountability. Paper two recommends adoption of both a Charter of Public Service values and disclosure legislation as integral parts of the federal government's accountability regime, and examines the Charter & disclosure ideas within a comparative context that focusses on Australia, New Zealand, and the United Kingdom. The third paper discusses challenges in administration of the Access to Information Act, the application of this legislation to bodies working for or with government, and possible areas of legislative & administrative reform. The fourth paper addresses the application & effectiveness of the Lobbyists Registration Act and suggests ways to mitigate its weaknesses. The fifth paper describes & analyzes the Public Works & Government Services Canada internal audit function in relation to the evolution of the Sponsorship Program, 1995-2000; canvasses a range of explanations for the failure of internal audit during this period; and assesses the October 2005 accountability & financial management reforms of the federal government. The last paper outlines overriding objectives in the management of government communications activities, including both advertising & sponsorships; reviews recent reforms in management & oversight of government advertising & sponsorship programs; and indicates directions for reform in this area.

Book Court Government and the Collapse of Accountability in Canada and the United Kingdom

Download or read book Court Government and the Collapse of Accountability in Canada and the United Kingdom written by Donald Savoie and published by University of Toronto Press. This book was released on 2008-05-10 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is a consensus throughout much of the western world that the public sector is in urgent need of repair. This study seeks to understand why this is so by comparing developments in Canada and the United Kingdom. It looks to changes in values both in society and inside government, and to the relationships between politicians and civil servants at the top and between civil servants and citizens at the bottom. Donald J. Savoie argues that both Canada and the UK now operate under court government rather than cabinet government. By court government, he means that effective power now rests with their respective prime ministers and a small group of carefully selected courtiers. For things that matter to prime ministers and their courts, the decision-making process shifts from formal to informal, involving only a handful of actors. For things that matter less to them, the decision-making process is horizontal, cumbersome, and consultative, and involves a multitude of actors from different government departments and agencies as well as a variety of individuals operating outside government. Court governments undermine both the traditionally bureaucratic model and basic principles that have guided the development of our Westminster-Whitehall parliamentary system. Nonetheless, Canada and the United Kingdom still cling to accountability requirements better suited to the past and the traditional bureaucratic model. Savoie concludes with a call for new accountability requirements that correspond with court government as well as the new relationships between politicians and civil servants, and civil servants and citizens.

Book Restoring Restraint

Download or read book Restoring Restraint written by Rebecca K.C. Hersman and published by Rowman & Littlefield. This book was released on 2018-07-27 with total page 69 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 2012, a 20-year moratorium on state employment of chemical weapons use was broken. Since then, there have been more than 200 uses, against civilians, military targets, and political enemies. These attacks have broken norms against the use of weapons of mass destruction and create a gap in the nonproliferation fabric—despite the robust international architecture of laws, treaties, agreements, and norms designed to restrain the proliferation and use of these weapons. Accountability for these recent attacks has been limited or nonexistent, which threatens the credibility of the nonproliferation regime and only encourages further use. Leaders must find the political and moral strength to use a full spectrum of tools to reestablish this system of restraint. By understanding the system—built on taboos, norms, deterrence, and a lack of benefits—and corresponding accountability approaches—military, legal, political, diplomatic, economic, and educational—leaders can utilize a menu of potential actions for building more diverse, flexible, scalable, and implementable options to hold accountable users of chemical weapons.

Book Reclaiming Accountability

  • Author : Heidi Kitrosser
  • Publisher : University of Chicago Press

Download or read book Reclaiming Accountability written by Heidi Kitrosser and published by University of Chicago Press. This book was released on 2015-01-06 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: Americans have long treated government accountability as a birthright. However, accountability is frequently tossed about in a rhetorically effective but substantively empty way. We often feel that those in government “work for us” and therefore must “answer to us,” but fail to grapple with the conditions under which we can really assess how accountable our government is. This is especially true with respect to matters of secrecy and transparency in government as, while we routinely voice support for transparency and accountability, we too often tolerate secrecy when associated with “national security.” The government plainly needs to keep some information secret, and there are ways to reconcile secrecy with accountability. In Reclaiming Accountability, unchecked secrecy is the primary concern as insufficient checking breeds unnecessary, even counterproductive, secrecy and is also deeply antithetical to accountability. Heidi Kitrosser shows how, for all of its influence, “presidentialism” badly misreads the Constitution. The book first explains presidentialism and its major component parts – “supremacy” and “unitary executive theory.” It then details how supremacy and unitary executive theory manifest themselves as arguments for a broad presidential power to control information. The descriptive elements lay the groundwork for Kitrosser's two normative arguments. The first is that the Constitution situates the presidency within a substantive accountability framework that entails substantial congressional and judicial leeway to impose and enforce external and internal checks on presidential power to foster transparency and accountability. And, closely related, the second argument is that supremacy and unitary executive theory misread the Constitution.
