En primer lugar, en su dimensión más positiva, como manifestación social de indudable trascendencia, en cuanto factor de integración, de tolerancia, de sana competitividad, a la vez que relevante instrumento educativo, capaz de fomentar la cooperación, la solidaridad, la inclusión social, y de unir a diferentes, de superar conflictos y desigualdades. Sin embargo, y ahora en su aspecto negativo, lo idílico de dicho componente básico afianzado en la idea motriz de un bondadoso desarrollo pasa a ser perturbado, cuando no denigrado, por conductas dañinas muy alejadas del pretendido y no siempre conseguido fair play deportivo. De tal modo, la legítima y encomiable lucha por la victoria se ve, a veces, desvirtuada por comportamientos violentos, manipuladores o fraudulentos que intentan alterar las competiciones, los resultados y, esencialmente, la pureza e integridad de este destacado fenómeno social que es el deporte. Y todo ello no solo sobre actitudes concretas contrarias al buen hacer deportivo, sino en hipótesis de mayor intensidad conculcadoras del Ordenamiento jurídico en general e, incluso, del ámbito punitivo, como ultima ratio de las reacciones jurídicas. Sujetos y objetos con multiplicidad de tipologías, de intereses y de motivaciones. Desde los propios participantes en los referidos eventos, directivos, jueces, árbitros, hasta sociedades y empresas que patrocinan o dirigen estructuras deportivas o creadas para tales efectos criminales, o meramente sujetos, profesionales del fraude y de la corrupción, que se acercan a las competiciones deportivas con la única finalidad de obtener rendimientos económicos ilegales. Ello ha supuesto, y así se plantea a lo largo del libro, que el estudio se dirija a las manifestaciones más intensas del fraude deportivo, con su análisis desde las diversas ramas del saber jurídico afectado. No se trata de seleccionar ocasionales derivaciones de corrupción o fraude deportivo sino de valorar el deporte en cuanto fenómeno jurídico, como proposición poliédrica que junto a sus múltiples valores ha de conseguir e interpretar según normas al respecto contestaciones armónicas a todo un conglomerado de intereses que giran en torno a él y a grupos, generalmente organizados, que los impulsan de manera ilegítima. Tal cometido interpretativo se ha llevado a cabo, coherentemente, desde una perspectiva pluridisciplinar, en el que han intervenido relevantes especialistas en Derecho penal, Derecho administrativo, Derecho financiero, Derecho mercantil, Derecho civil. En consecuencia, el soporte rector de la obra camina por valoraciones críticas y suficientemente profundas del fraude en el deporte, entendido aquí, en su comprensión restrictiva –delimitada por unos componentes amplios pero al mismo tiempo limitativos de la total concepción de fraude en esta actividad, así amaños de partidos, alteración de competiciones, o corrupción en la estructura de negocios en el deporte, incluidas las apuestas– seguida con exactitud a lo largo de su contenido, al que se ha añadido determinadas incursiones en materias no totalmente tasadas en este sentido pero de incidencia y proyección en alguna de ellas.

El tiempo dirá si este tipo de nuevo cuño es acertado en cuanto a la oportunidad de la injerencia del Derecho penal en un sector de la sociedad fuertemente sometido a reglas disciplinarias y administrativas, así como su la técnica utilizada y la ubicación elegida han sido lo más apropiadas, o si bien, de nuevo, lo que ha hecho el legislador ha sido utilizar simbólicamente el Derecho penal, como técnica de respuesta futura ante unos hechos que en un momento dado saltan a los medios de comunicación, así como de "amenaza genérica" frente a los posibles sujetos de estas conductas, sin una realidad de aplicación práctica posible. El tiempo dirá si la redacción dada al tipo en cuestión no pasa de ser una simple figura testimonial, de utilización demagógica, como por ejemplo ocurre con el delito de dopaje del artículo 361 bis CP, o si -por el contrario- efectivamente está dotada de un contenido propio, que se irá perfilando y puliendo en sus complejas artistas a través de la interpretación doctrinal y jurisprudencial subsiguiente, convirtiéndose en un instrumento de aplicación práctica a los casos más graves de conductas fraudulentas en el deporte. No deben olvidarse al respecto, las cifras astronómicas que el deporte mueve en España, además de la fuerte incidencia social que le es inherente, en tanto que se estoma que "en el terreno económico representa el 2.4 por ciento del producto interior bruto".
