Available in PDF, EPUB and Kindle. Book excerpt: There is a great difficulty in the way of a writer who attempts to sketch a living Constitution-a Constitution that is in actual work and power. The difficulty is that the object is in constant change. An historical writer does not feel this difficulty: he deals only with the past; he can say definitely, the Constitution worked in such and such a manner in the year at which he begins, and in a manner in such and such respects different in the year at which he ends; he begins with a definite point of time and ends with one also. But a contemporary writer who tries to paint what is before him is puzzled and a perplexed: what he sees is changing daily. He must paint it as it stood at some one time, or else he will be putting side by side in his representations things which never were contemporaneous in reality.

Book Responsible Government and the Australian Constitution

Download or read book Responsible Government and the Australian Constitution written by Benjamin B Saunders and published by Bloomsbury Publishing. This book was released on 2023-06-15 with total page 271 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at responsible government under the Australian Constitution. It undertakes a detailed examination of the history leading to the incorporation of responsible government into the Constitution, examining the political history and constitutional ideas which informed the framers' views. It draws on this history to develop a theory of responsible government and explore its implications for the interpretation of the Constitution and the structure of modern government in Australia. The book fills a major gap in our knowledge of the intellectual background of the Australian Constitution by explaining the constitutional ideas that have shaped the text and structure of the Australian Constitution. It contributes to worldwide debates about constitutional interpretation by showing how rigorous use of history can lead to novel interpretations of constitutions without being tied to the 'dead hands of the founders'.

Book The Oxford Handbook of Australian Politics

Download or read book The Oxford Handbook of Australian Politics written by Jenny M. Lewis and published by Oxford University Press. This book was released on 2021-10-20 with total page 568 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Australian Politics is a comprehensive collection that considers Australia's distinctive politics— both ancient and modern— at all levels and across many themes. It examines the factors that make Australian politics unique and interesting, while firmly placing these in the context of the nation's Indigenous and imported heritage and global engagement. The book presents an account of Australian politics that recognizes and celebrates its inherent diversity by taking a thematic approach in six parts. The first theme addresses Australia's unique inheritances, examining the development of its political culture in relation to the arrival of British colonists and their conflicts with First Nations peoples, as well as the resulting geopolitics. The second theme, improvization, focuses on Australia's political institutions and how they have evolved. Place-making is then considered to assess how geography, distance, Indigenous presence, and migration shape Australian politics. Recurrent dilemmas centres on a range of complex, political problems and their influence on contemporary political practice. Politics, policy, and public administration covers how Australia has been a world leader in some respects, and a laggard in others, when dealing with important policy challenges. The final theme, studying Australian politics, introduces some key areas in the study of Australian politics and identifies the strengths and shortcomings of the discipline. The Oxford Handbook of Australian Politics is an opportunity for others to consider the nation's unique politics from the perspective of leading and emerging scholars, and to gain a strong sense of its imperfections, its enduring challenges, and its strengths.

Book Ministerial Advisers in Australia

Download or read book Ministerial Advisers in Australia written by Yee-Fui Ng and published by Holt Prize. This book was released on 2016 with total page 225 pages. Available in PDF, EPUB and Kindle. Book excerpt: From their origins in the shadows of Australian public administration, ministerial advisers have been increasingly thrust into the limelight through scandals that appear on the front page of the newspapers. This book traces the rise in the power and significance of Australian ministerial advisers. It shows the fundamental shift of the locus of power from the neutral public service to highly political and partisan ministerial advisers. The book demonstrates that the introduction of ministerial advisers into the structure of the Executive has led to the erosion of the Australian system of responsible government. This is caused by a failure in the political, legal and managerial accountability frameworks surrounding ministerial advisers.Ministerial Advisers in Australia is the first comprehensive study of the legal and political regulation of Australian ministerial advisers. This book features material from original interviews with Australian Ministers and Members of Parliament, as well as several former State Premiers.**Dr Yee-Fui Ng, Ministerial Advisers in Australia: The Modern Legal Context, was a finalists of the inaugural Holt Prize 2015.

Book excerpt: Law and Democracy: Contemporary Questions provides a fresh understanding of law’s regulation of Australian democracy. The book enriches public law scholarship, deepening and challenging the current conceptions of law’s regulation of popular participation and legal representation. The book raises and addresses a number of contemporary questions about legal institutions, principles and practices: How should the meaning of ‘the people’ in the Australian Constitution be defined by the High Court of Australia? How do developing judicial conceptions of democracy define citizenship? What is the legal right to participate in the political community?Should political advisors to Ministers be subject to legal accountability mechanisms? What challenges do applied law schemes pose to notions of responsible government and how can they be best addressed? How can the study of the ritual of electoral politics in Australia and other common law countries supplement the standard account of democracy? How might the ritual of the pledge of Australian citizenship limit or enhance democratic participation? What is the conflict between legal restrictions of freedom of expression and democracy, and the role of social media? Examining the regulation of democracy, this book scrutinises the assumptions and scope of constitutional democracy and enhances our understanding of the frontiers of accountability and responsible government. In addition, key issues of law, culture and democracy are revealed in their socio-legal context. The book brings together emerging and established scholars and practitioners with expertise in public law. It will be of interest to those studying law, politics, cultural studies and contemporary history.
