Book excerpt: El presente trabajo se centra en el estudio de la responsabilidad penal —y civil derivada de la anterior— que tiene su origen en la omisión de las medidas de seguridad exigidas por la normativa aplicable en las obras de construcción. La novedad del planteamiento que realizo radica en que, por un lado, la obra se focaliza en el ámbito concreto de la construcción y, por otro lado, en que se lleva a cabo un análisis íntegro del accidente laboral, abordando la totalidad de cuestiones que pueden plantearse en la jurisdicción penal. Consta la obra de tres partes: Una primera centrada en el delito contra la seguridad en el trabajo en el sector de la construcción, identificando los agentes que intervienen en el proceso de construcción, examinando las obligaciones que en materia de seguridad de los trabajadores a cada uno de ellos impone la normativa reguladora para, a partir de ahí, determinar la responsabilidad penal en que pueden incurrir por la falta de adopción de las medidas de seguridad necesarias en las obras de construcción. La segunda parte comprende el estudio de los delitos de resultado en que puede concretarse el peligro para su vida o integridad física a que se ven expuestos los trabajadores del sector de la construcción debido a la omisión de las medidas de seguridad legalmente exigidas. La tercera parte se reserva al estudio de las consecuencias jurídicas legalmente previstas para el caso de comisión de estos delitos, tanto las penas como la responsabilidad civil.
