Book excerpt: Desgraciados acontecimientos recientes han reabierto el debate sobre las medidas administrativas deportivas e incluso penales, además de privilegiar los aspectos preventivos en referencia a la violencia exógena. La CONMEBOL, como medida de corte provisorio, decidió que el partido se jugara en España donde se instauró un sistema sin precedentes conformado por tres anillos de seguridad establecidos por los Fuerzas y Cuerpos de Seguridad del Estado además de Seguridad Privada que llevó a buen puerto la finalísima de tan magno acontecimiento. Junto a este tipo de violencia, se pretende realizar un estudio del resto de líneas de ésta que aspira acercar al lector a cada una de las eventualidades que se observan en esta materia dentro del escenario deportivo. De esta forma, además de la exógena, se estudiará la violencia endógena, desarrollada dentro del terreno de juego, la incitación al odio y la violencia gestual que se observa en una ingente cantidad de estadios de primer orden mundial en los que se transgreden derechos fundamentales y libertades públicas como pudiera ser el honor. A la par, se analizará la novedosa violencia machista de gran calado en el universo deportivo actual y todo ello desde la perspectiva de la Reforma 1/2015 del Código Penal. El propósito de esta monografía no es otro que incidir en todos y cada uno de los rincones de la violencia trayendo a colación la exorbitante casuística acontecida, junto a una prospección sociológica sobre la cuestión. Igualmente, se diseccionará la realización de hechos violentos dentro de los recintos deportivos desde el prisma del Derecho penal e incluso la posible responsabilidad que pudieran tener los clubes; por otro lado, se hará mención al lenguaje bélico y su posible repercusión en el ámbito violento por parte de los actores que circundan el teatro mediático deportivo. Conjuntamente, se mencionarán dos aspectos importantes para el desarrollo de esta publicación: la consideración de la existencia de un Derecho penal autónomo del deporte y la delimitación entre los mecanismos del control social del Derecho administrativo deportivo y del Derecho penal desde la óptica del principio non bis in idem. El autor, José Manuel Ríos Corbacho, Profesor Titular de Derecho penal de la Universidad de Cádiz y Director del Forum de Derecho, Ética y Deporte de la Universidad de Cádiz, es Subdirector de la Revista Fair Play, miembro de la Asociación Española de Filosofía del Deporte, del Consejo Científico de la Red Iberoamericana de Investigadores de Derecho y Gestión del Deporte y de las Asociaciones Española y Andaluza de Derecho Deportivo. Colaborador e Investigador de la Cátedra de Estudios e Investigación en el Derecho del Deporte de la Universidad de Granada. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.
