Excerpt: ...depot at Ludgate Hill, preparatory to its removal to their works, a distance of about three quarters of a mile, for repair. W'hile engaged in this work he strained the muscles of his back. There was no machinery or power in use at the depot in Ludgate Hill, but on its arrival at the works at St. Luke's, the fan was to be repaired by the use of machinery driven by a gas-engine. In this matter the workman strained his back while taking to pieces a revolving ventilating fan in the smoking-room of the employcrs' depot at Ludgate Hill for the purpose of sending the pieces to the employers' repairing factory at Golden Lane, St. Luke's, where it was to be repaired by the use of machinery driven by a gas-engine. The contention of the workman was that he was injured while at work on or in or about engineering work within the words of the Act. That was disputed by the employers. The Court of Appeal decided in the recent case of Back v. Dick, Kerr & Co. (1905, 2 K. B. 148; 7 W. C. C. 45) that engineering work does not mean labour bestowed on such work but the locality where such labour is bestowed. The process of repairing the fan did not become engineering work till the pieces reached Golden Lane when machinery was used upon them. The work done at Ludgate Hill was not engineering work though preliminary and essential to the subsequent engineering work. It is impossible to say, in my opinion, that work done at the premises in Ludgate Hill was done in or about those in Golden Lane. Excerpt: ...Act, 1897 (60 & 61 Vict. c. 37), provides: Sec. 1.--(1) If in any employment to which this Act applies personal injury by accident arising out of and in the course of the employment is caused to a workman, his employer shall, subject as hereinafter mentioned, be liable to pay compensation in accordance with the first schedule to this Act. Sec. 7.--(1) This Act shall apply only to employment by the undertakers, as hereinafter defined... on, in, or about any building which exceeds thirty feet in height, and is either being constructed or repaired by means of a scaffolding, or being demolished.... The County Court Judge found that the arrangement in question was a " scaffolding" within the meaning of the Act. He further found that, apart from the whitewashing and distempering, none of the other works comprised in the estimate and additional work were in progress at the time of the accident, and that no scaffolding was being used for their execution; and that the-scaffolding was being used only for the purpose of whitewashing and distempering walls and ceilings, and for the preparation of the walls and ceilings in the ordinary way for that purpose. The County Court Judge held, upon the authority of Wood v. Walsh (1899 1 W. C. C. 68), that the building was not "being repaired" within the meaning of sec. 7 (1) of the Act, and made his award in favour of the respondents. The applicants having appealed, the hearing of the appeal was adjourned until after the decision of the appeal to the House of Lords in Hoddinott v. Newton, Chambers, J? Co. (ante, p. 74).
