Book excerpt: The Government published a consultation document "Export Control Act 2002: 2007 review of export control legislation" in June 2007 (further details can be accessed at http://www.berr.gov.uk/consultations/page39910.html). This report contains the Quadripartite Committee's own review of export control legislation, along with its response to the Government's consultation document. The Committee concludes that the Export Control Act 2002 has provided a sound legislative basis for controlling and regulating the UK's strategic exports but with gaps and shortcomings. It also welcomes the Government's review as a constructive process that addresses many of the issues the Committee and other parties have raised over several years, and praises the improvement in the volume and quantity of information that the Government provides. But the review does not mention HM Revenue and Customs, the department that enforces the controls; and it ignores the EU dimension despite a significant part of the export control regime being derived from EU legislation. The Committee makes nearly 100 recommendations and observations on the review and the operation and effectiveness of the UK export control legislation.

Book excerpt: The Committee's findings include that the Smart Acquisition procurement programme, introduced by the Ministry of Defence (MoD) in 1998, has failed to deliver on almost all counts. In 2002-03, the top 20 defence equipment projects experienced in-year cost increases totalling £3.1 billion, as well as time delays on promised delivery dates. The head of the Defence Procurement Agency has found that only one of the seven principles underlying Smart Acquisition has been implemented in full, and a fundamental overhaul of the initiative has been announced. On specific projects, the Committee's findings include that the in-service date for Eurofighter/Typhoon was achieved during 2003, a total of 54 months late; and an assessment phase contract for the Future Rapid Effect System (FRES) is to be placed at the end of the year, although there are concerns that the in-service date of 2009 is unrealistic.

They thus contribute to the perpetuation of a hierarchical world military order and the construction of the South as a site of Northern benevolence and intervention. The Committees have scrutinised in unprecedented detail the Government's latest (2010) Annual Report on Strategic Export Controls (HC 1402, session 2011-12, ISBN 9780102973662), the Government's quarterly information on individual export licence approvals and refusals, and the Government's policies and performance on arms export controls and on arms control generally. The Committees conclude that the Government's review of its policies and practices on arms exports following the Arab Spring should not have been carried out merely as "an internal review" and should instead have been the subject of public consultation in accordance with the Government's stated policy of transparency on arms exports. And whilst the Government's introduction of a new licence suspension mechanism is welcome, this is not sufficient to ensure that arms exported are not used for internal repression overseas because in many cases the arms will have left the UK before suspension occurs. The Government should extend its arms export policy review from countries in the Middle East and North Africa to authoritarian regimes and countries of human rights concern worldwide. Annex 7 of the report gives selected arms export licence approvals by the Government to countries of human rights concern, and the report also contains details of the extant UK Government approved arms export licences to Argentina, Bahrain, Egypt, Libya, Saudi Arabia, Syria, Tunisia and Yemen.
