Book excerpt: "In April 1998 the Independent Commission Against Corruption released the first of two reports on the enquiry by the Commission (ICAC) into Aboriginal Land Councils in New South Wales. The recommendations put forward by the ICAC in April 1988, included Recommendation 1 under the heading of "Model Rules Project" and which stated: "The NSW Aboriginal Land Council in conjunction with the Registrar and the ICAC develop a project to explore options for decision-making models which might be more appropriate for different Local Aboriginal Land Councils". The ICAC report went on to say that the project should incorporate a process for testing the different models and determining the effects of their use in relation to improved participation, equity in access to resources, and effectiveness of decision-making. It was also suggested by ICAC that the Aboriginal Land Rights Act should be amended as required to allow the project to be undertaken and the results implemented. Subsequent to the release to this report (released in two parts), it was agreed between the abovementioned stakeholders that the Office of the Registrar, Aboriginal Land Rights Act would take the lead in initating the implementation of a Model Rules Project, with the ongoing support of the other stakeholders" -- from page 3.

Book World Development Report 2017

Download or read book World Development Report 2017 written by World Bank Group and published by World Bank Publications. This book was released on 2017-01-23 with total page 605 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why are carefully designed, sensible policies too often not adopted or implemented? When they are, why do they often fail to generate development outcomes such as security, growth, and equity? And why do some bad policies endure? World Development Report 2017: Governance and the Law addresses these fundamental questions, which are at the heart of development. Policy making and policy implementation do not occur in a vacuum. Rather, they take place in complex political and social settings, in which individuals and groups with unequal power interact within changing rules as they pursue conflicting interests. The process of these interactions is what this Report calls governance, and the space in which these interactions take place, the policy arena. The capacity of actors to commit and their willingness to cooperate and coordinate to achieve socially desirable goals are what matter for effectiveness. However, who bargains, who is excluded, and what barriers block entry to the policy arena determine the selection and implementation of policies and, consequently, their impact on development outcomes. Exclusion, capture, and clientelism are manifestations of power asymmetries that lead to failures to achieve security, growth, and equity. The distribution of power in society is partly determined by history. Yet, there is room for positive change. This Report reveals that governance can mitigate, even overcome, power asymmetries to bring about more effective policy interventions that achieve sustainable improvements in security, growth, and equity. This happens by shifting the incentives of those with power, reshaping their preferences in favor of good outcomes, and taking into account the interests of previously excluded participants. These changes can come about through bargains among elites and greater citizen engagement, as well as by international actors supporting rules that strengthen coalitions for reform.

Book Operations Jasper and Acacia Addressing Outstanding Questions

Download or read book Operations Jasper and Acacia Addressing Outstanding Questions written by New South Wales. Independent Commission Against Corruption and published by . This book was released on 2013 with total page 49 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The Independent Commission Against Corruption (ICAC) recommends that the NSW Government considers enacting legislation to cancel the coal exploration licences (ELs) for Doyles Creek, Mount Penny and Glendon Brook. In its report, Operations Jasper and Acacia – addressing outstanding questions, released today, the Commission says that the granting of the authorities (terminology used in the Mining Act 1992 to refer to an exploration licence, an assessment lease or a mining lease) for Doyles Creek, Mount Penny and Glendon Brook was so tainted by corruption that those authorities should be expunged or cancelled and any pending applications regarding them should be refused. The report says that the recommended legislation could be accompanied by a power to compensate any innocent person affected by the expunging (and, if the NSW Government deems it appropriate, any refusal to grant relevant pending applications) to the extent that this was considered appropriate. Such legislation would have the benefit of reducing risks arising from challenges in the courts to any ministerial decision to cancel or not renew current licences or leases and to refuse to grant any authorities."--Website summary.

Book The Role of Parliament in Curbing Corruption

Download or read book The Role of Parliament in Curbing Corruption written by Rick Stapenhurst and published by World Bank Publications. This book was released on 2006-01-01 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: In most countries, parliament has the constitutional mandate to both oversee government and to hold government to account; often, audit institutions, ombuds and anti-corruption agencies report to parliament, as a means of ensuring both their independence from government and reinforcing parliament's position at the apex of accountability institutions. At the same time, parliaments can also play a key role in promoting accountability, through constituency outreach, public hearings, and parliamentary commissions. This title will be of interest to parliamentarians and parliamentary staff, development practitioners, students of development and those interested in curbing corruption and improving governance in developing and developed countries alike.

Book Global Corruption Report 2001

Book excerpt: The Global Corruption Report 2001 is the new annual publication of Transparency International, the leading global anti-corruption NGO. By providing an overview of the "state of corruption" around the globe, the Global Corruption Report fills a significant gap in the existing literature. It assembles news and analysis on corruption and the fight against it around the world, highlighting international and regional trends, and significant instances of reform. It also reveals the links between global, regional and national developments in the corruption field, and does so from the independent perspective of an NGO. The book includes reports by leading experts on topical issues such as political party funding, money laundering, and corruption in international sport, exploring in particular the global nature of these themes. It also contains 12 regionally-focused reports, written by journalists from around the world. The report's final data and research section delivers a unique survey of the contemporary corruption and anti-corruption research terrain, with contributions from a range of IGOs, NGOs, the private sector, and academics. It also contains TI's own well-known Corruption Perceptions Index (CPI). The Global Corruption Report is a "must have" publication for policy-makers, business people, lawyers, journalists, academics, and anti-corruption activists the world over.

Book Passage of Change

Download or read book Passage of Change written by Anita Jowitt and published by ANU E Press. This book was released on 2010-11-01 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Numerous issues face Pacific states trying to find their way in the early 21st century. Countries are striving to secure the benefits of modernisation. Governance, law and order are needed to reach such a goal, but development cannot be at the price of culture or the environment. The question of how to develop and maintain sound legal systems and legal rules whilst maintaining the unique cultural heritages within the Pacific is a challenge with no easy answer. This interdisciplinary collection locates issues of law and governance within the particular socio-political context of the Pacific island region, presenting sociological, anthropological and political insights alongside jurisprudential analysis. Key issues including corruption, the role of customary law in modern legal systems, the place of human rights in the Pacific, environmental issues and the structure of the state are explored from a variety of perspectives.

The unique styles of conceptualising food systems and writing about them were preserved. Photographs and tables accompany each chapter.
