Van Boven has been a life-long scholar and practitioner of human rights. He served in the Dutch Ministry of Foreign Affairs, represented The Netherlands in the UN Commission on Human Rights, served as an expert in its Sub-Commission on Human Rights, and also on the Committee on the Elimination of Racial Discrimination. He was the Director of the UN Human Rights secretariat from 1977 to 1982, and later served as Registrar of the International Criminal Tribunal for the Former Yugoslavia and for Rwanda, and as UN Special Rapporteur against Torture. As Director of the UN Human Rights secretariat, Professor van Boven built up the protection capacity of the United Nations piece by piece and thereby transformed the UN's role. He initiated every protection mechanism in use at the United Nations today. He was thus the father of the contemporary system of United Nations protection. This book is a priceless study of leadership and strategy. If one is to be able to deepen the protection capacity of the UN in the future, it is crucial to understand how the foundations were laid. This book, based on the personal papers of Professor van Boven and of the author, who was his Special Assistant, tells the story of his remarkable leadership of the UN Human Rights secretariat.

It reproduces summaries by UN High Commissioners for Human Rights on the state of the national human rights protection systems of each UN Member State. These summaries were sent following each state’s passage through the Universal Periodic Review (UPR) process of the UN Human Rights Council. The summaries identify each state’s constitutional, legal, judicial and institutional architecture, international conventions not yet ratified, areas of progress, problem areas, and problems affecting different parts of the population. The High Commissioners’ summaries reproduced here are preceded by insightful reflections on the concept of a national human rights protection system, and by regional outlines of national human rights protection systems in the Americas and the Caribbean, Europe Africa, Asia and the Pacific. Defenders often face serious threats and can experience harm by state and non-state actors. Since the United Nations General Assembly's adoption of the Declaration on Human Rights Defenders in 1998, there has been considerable effort to recognise and protect the right of individuals, groups and communities to promote and protect their own rights and the rights of others. Over time, a multi-level, multi-actor international protection regime for the rights of human rights defenders has emerged, which is based on existing rights derived from the international human rights regime. The authors in this book reflect on the positive developments that have emerged over time to strengthen the protection of defenders, as well as the debates, tensions and contestations in such practices. This collection provides a critical appraisal of the construction, function, ethical boundaries, and evolution of this protection regime, as well as its multi-scalar social and political effects. In particular, the authors consider the effectiveness of particular international and regional protection mechanisms for the protection of defenders, and examine the relationship between repression, activism, and tactics for managing risks in the face of danger. Book excerpt: The implementation of the recommendations of the 3rd Summit of Heads of State and Government of the Council of Europe (Warsaw, May 2005) resulted in the launch in 2006 of a number of European campaigns, in particular "Building a Europe for and with children"; the "Campaign to combat trafficking in human beings"; "All different, All equal"; "Stop domestic violence against women"; and the 'Dosta!" awareness-raising campaign to end prejudice against the Roma. Kosovo was a major political concern for the Council of Europe. Through its Venice Commission, it provided expert input for the preparation of the future status of the region and continued to provide expert advice on the implementation of European standards in such fields as the protection of human rights, minority rights, decentralisation, cultural heritage protection and constitutional law. The Republic of Montenegro applied for membership of the Council of Europe following the 21 May referendum, which paved the way for its independence. Serbia, on the other hand, succeeded the former State Union of Serbia and Montenegro as a member state of the Organisation. The Council of Europe was the first organisation to look into the allegations of secret detentions and unlawful transfers of suspected terrorists in the member states. The Parliamentary Assembly and the Secretary General each carried out investigations which revealed that Council of Europe member states have not set up effective legal safeguards against such practices, which violate the European Convention on Human Rights.

The UN and others have encouraged states to set up such institutions as an indication of their commitment to human rights, and now over 20 such institutions exist in Africa and many more will follow. These institutions have taken various forms including ombudsmen, commissions, or a combination of the two. They differ in terms of how they are established; some by constitution, some by legislation and some by decree. These NHRIs have varying functions, usually both promotional and protective, such as giving advice to government, parliament, and others, making recommendations on compliance with human rights standards, awareness raising, and analysis of law and policy. Despite the considerable variations in the method of their creation, powers and composition, most of these institutions have chosen or indeed been mandated, to become involved in international and regional fora. This book examines these institutions in the African region, the way in which they use the international and regional fora, the effectiveness of their contributions and how they are able to participate.

Assessing NHRIs’ capacity to do so is vital as the future of human rights protection lies at the national level, and other parts of the architecture—the ASEAN Intergovernmental Commission on Human Rights (AICHR), and the international mechanism of the Universal Periodic Review (UPR)—though helpful, also have their limitations. The critical question the book addresses is whether NHRIs individually or collaboratively provide protection of fundamental human rights. The body of work offered in this book showcases the progress of the NHRIs in Southeast Asia where they also act as a barometer for the fluid political climate of their respective countries. Specifically, the book examines the NHRIs’ capacity to provide protection, notably through the pursuit of quasi-judicial functions, and concludes that this function has either been eroded due to political developments post-establishment or has not been included in the first place. The book’s findings point to the need for NHRIs to increase their effectiveness in the protection of human rights and invites readers and stakeholders to find ways of addressing this gap.
