The objective of the Workshop was to develop national capacity and promote bilateral, sub-regional and/or regional coordination so that countries will be better placed to strengthen and harmonize port State measures and, as a result, implement the relevant International Plan of Action to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (IPOA-IUU) tools and the FAO Model Scheme and contribute to the development of a legally-binding instrument on port State measures. The Workshop addressed: background and framework for port State measures; global and regional issues relating to IUU fishing and port State measures, and the 2005 FAO Model Scheme on Port State Measures to Combat IUU Fishing; the 2007 draft Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing and the implementation of regional and national port State measures; adoption and implementation of port State measures by regional fisheries management organizations (RFMOs) and the implementation of measures in the Southern and East Africa subregion; operational and information requirements for effective port State measures; industry perspectives on port State measures and national responses to questionnaires; and key issues for further action and cooperation in strengthening and harmonizing port State measures. Working groups were formed to enhance the participatory nature of the Workshop and as a means of engendering broader and deeper discussion on concepts and issues relating to port State measures. In one exercise they addressed various aspects of port State measures, and recommended and prioritized areas for regional cooperation in implementing port State measures. They also identified further types of support needed to implement port State measures and in another exercise they considered certain thematic aspects relating to the FAO Model Scheme and the draft Agreement on port State measures. This exercise included legal aspects, information requirements, systems and inspection procedures, the results of inspection and training. Funding and support for the Workshop were provided by the FAO Regular Programme, by the Government of Norway through the Trust Fund for Port State Measures (MTF/GLO/206/MUL) and the FishCode Programme (MTF/GLO/125/MUL [Sweden-SIDA] [SWE/05/IUU Port State Measures/IUU fishing]). Funding was also provided by the UK Department for International Development (DFID).

The meeting brought together RFBs with diverse mandates from all geographic regions, including FAO and non-FAO regional fishery bodies, marine and inland fishery advisory and management bodies, the UNDOALOS and other invited organizations. The meeting allowed participants to exchange views and discuss both global fisheries management and development issues in aquaculture, as these related to regional and global processes of particular relevance to RFBs. In addition, RSN-8 provided the opportunity to discuss the development and strengthening of the RSN, as well as a space for reflection on the outcomes of COFI 34 and their implications for regional fishery bodies. The meeting had a high level of participation, which underlined the role of the network as a unique forum in which to foster cooperation, facilitate discussion and share experiences.

Book excerpt: The growing quantity of plastic waste in the marine environment including abandoned, lost or otherwise discarded fishing gear (ALDFG) is a global problem. A particular feature of ALDFG is the potential of some gears to carry on fishing for many months or even years. The study examines legal responses to ALDFG in the context of marine fisheries. After discussing the nature of the problem of ALDFG and some of the reasons why fishing gear is abandoned, lost, or otherwise discarded, the study examines the response of the international community to ALDFG. A key finding is that ALDFG is at the same time, a fishing issue, a navigation problem (of vessel source pollution) and an environmental problem with the resulting involvement of FAO, IMO and UNEP as well as the UN General Assembly. After examining potential legal approaches to the problem, the study then describes the basic legal and institutional arrangements in four case study jurisdictions that have adopted legal measures to address ALDFG, namely Australia, the European Union and its Member States, Norway and the USA finding once again the tripartite responsibility of fisheries, navigation and environment ministries/agencies. The inter-sectoral nature of ALDFG suggests the need for a collaborative and coordinated approach. While not all of the case study jurisdictions make use of all ten of the individual legal measures identified, the case studies also clearly show that ALDFG is a problem that is susceptible to a legal response at the national or regional level including through the use of extended producer responsibility schemes, various reporting requirements and gear standards. Legal tools to address the problem of ALDFG clearly exist. The extent to which some, or all, of them are necessary or appropriate in a given context at national, regional or global level is not ultimately a legal question but a political one.
