This book was released on 2023-09-25 with total page 497 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this very useful analysis of constitutional law in Botswana provides essential information on the country’s sources of constitutional law, its form of government, and its administrative structure. Lawyers who handle transnational matters will appreciate the clarifications of particular terminology and its application. Throughout the book, the treatment emphasizes the specific points at which constitutional law affects the interpretation of legal rules and procedure. Thorough coverage by a local expert fully describes the political system, the historical background, the role of treaties, legislation, jurisprudence, and administrative regulations. The discussion of the form and structure of government outlines its legal status, the jurisdiction and workings of the central state organs, the subdivisions of the state, its decentralized authorities, and concepts of citizenship. Special issues include the legal position of aliens, foreign relations, taxing and spending powers, emergency laws, the power of the military, and the constitutional relationship between church and state. Details are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for both practising and academic jurists. Lawyers representing parties with interests in Botswana will welcome this guide, and academics and researchers will appreciate its value in the study of comparative constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: Annotation. The European Constitutional Convention offers a historical opportunity to rethink and to improve the governance and organization of the European Union. At stake is Europe's political architecture: the form that government takes and the allocation of responsibilities between the member states and supranational bodies. Many reform proposals have already been offered to the Convention. This Report provides a method for evaluating those options, developing an analytical framework derived from recent developments in the theory of positive political economy. On this basis the authors conclude that a presidential system of governance is likely to be best adapted to Europe -- and specifically to the need to expand the competency of the EU in the areas of internal and external security (Europe's Second and Third Pillars). In a full-blown presidential system, the Commission would have well-defined executive powers, specified by the Council, and a president elected by the citizens of Europe. The European executive would be subject to checks and balances by both the Council and the European Parliament. But political realism excludes adopting such a solution in the short run. The authors therefore propose an evolutionary strategy: the election of the Commission president by a college of country representatives appointed in the short run by national parliaments, leaving the option open to individual countries to allocate their votes for the presidency via universal suffrage. This solution would preserve the option of moving to a fully-fledged presidential model sometime in the future, while providing enhanced democratic legitimacy from the start. In general, the Constitution should be long on principles and general rules and short on details so as to allow Europe's governance to evolve within an unchanged Constitution. Book jacket.

Available in PDF, EPUB and Kindle. Book excerpt: Litigating War offers an in-depth examination of the law and procedure of the Eritrea-Ethiopia Claims Commission, which was tasked with deciding, through binding arbitration, claims for losses, damages, and injuries resulting from the 1998-2000 Eritrean-Ethiopian war. After providing an overview of the war, the authors describe how the Commission was established, its jurisdiction, the sources of law it applied, its treatment of nationality and evidentiary issues, and the relief it rendered. Separate chapters then address particular topics, such as the initiation of the war, battlefield conduct, belligerent occupation, aerial bombardment, prisoners of war, enemy aliens and their property, diplomats and diplomatic property, and general economic loss. A final chapter examines the lessons that might be learned from the experience of the Claims Commission, especially with an eye to the establishment of such commissions in the future. The volume includes a preface from James Crawford and also reproduces all the key documents relating to the Commission: the bilateral agreement establishing the Commission; its rules of procedure; and its numerous decisions and arbitral awards. The analytical portion of the volume contains extensive cross-references to these primary documents. Further, a comprehensive table of contents and indexes relating to subject matter, treaties, and cases provide ready access to all the material contained within.

Book Adivasis Migrants and the State in India

Download or read book Adivasis Migrants and the State in India written by Jagannath Ambagudia and published by Taylor & Francis. This book was released on 2018-12-07 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the contested relationship between Adivasis or the indigenous peoples, migrants and the state in India. It delves into the nature and dynamics of competition and resource conflicts between the Adivasis and the migrants. Drawing on the ground experiences of the Dandakaranya Project – when Bengali migrants from erstwhile East Pakistan (now Bangladesh) were rehabilitated in eastern and central India – the author traces the connection between resource scarcity and the emergence of Naxalite politics in the region in tandem with the key role played by the state. He critically examines the way in which conflicts between these groups emerged and interacted, were shaped and realised through acts and agencies of various kinds, as well as their socio-economic, cultural and political implications. The book explores the contexts and reasons that have led to the dispossession, deprivation and marginalisation of Adivasis. Through rich empirical data, this book presents an in-depth analysis of a contemporary crisis. It will be useful to scholars and researchers of political studies, South Asian politics, conflict studies, political sociology, cultural studies, sociology and social anthropology.

Book excerpt: The world has become obsessed with the Western notions of progress, development, and globalization, the latter a form of human and economic homogenization. These processes, through the aegis of the United Nations, are comparatively monitored. Those nations deemed to be ‘lagging behind’ are then provided with foreign aid and developmental assistance. For nearly seventy years, India has sought its place in this global endeavour; yet, even today, abject poverty and backwardness can be observed in districts in almost every state; with the highest concentration of such districts found in the state of Bihar and a cultural enclave, known as Mithila. Development in India has been elusive because it is difficult to define; and because the Western concepts of development and progress have no absolute equivalents within many non-Western settings. As a consequence, development programmes often fail because they are unable to ask the right questions, but equally important is the political economy derived from foreign aid. For politicians, there is no long-term benefit to be derived from successful development. In general, foreign aid only serves to corrupt governments and politicians and, in the end, does very little for those who need help. The struggling states of Bihar and Mithila serve as extreme examples of India‘s problems. Development here has been thwarted by a hereditary landed aristocracy supported by religion, casteism, custom, social stratification, tradition, and patterns of behaviour that can be traced back millennia. In turn, all these have been masterfully manipulated by co-opted politicians, who have turned politics into a veritable art form as this volume comprehensively demonstrates.
