The pressure Of additional duties placed upon this Department as a result of war conditions makes it necessary for me to postpone until a later date as full a summary of the legal business of the Commonwealth as I would ordinarily con sider pertinent in such a report. A statement of appropriations and expenditures, the number of cases requiring the attention of this Department during the period of the report, and the details of capital cases, customarily included in such a report, appear on succeeding pages. The statute requires also a statement Of his acts under section nine. Section 9 requires the Attorney General to give aid and advice when required by either branch of the General Court in the. Arrangement and preparation Of legislative documents and to give his Opinion upon questions Of law submitted to him by the governor and council or by either branch of the general court. This section also contains a requirement that the Attorney General or some person designated by him, shall, when requested by a vote of a legislative committee, appear before such committee and advise it upon the legal effect of proposed legislation pending before it. Book excerpt: Excerpt from Report of the Attorney General for the Year Ending June 30, 1954 The Office of the Attorney General has sponsored new legislation, cre ated new divisions within the department, rendered legal opinions to the proper authorities, represented the Commonwealth and the various State departments, Officers and commissions in all judicial proceedings, examined and approved town by-laws, conducted investigations into the conduct of various agencies and certain public Officials of the Commonwealth, co operated with the district attorneys, conscientiously administered the law and vigorously prosecuted all violators. And yet, as time-consuming as these many activities have been, the Office of Attorney General has also been able to give assistance to the needy, such as the unfortunate victims of the disastrous Worcester tor nado and the hurricane on Cape Cod, continue economical land-taking reforms, initiate a campaign to clean up comic books and continue aid to veterans. Staffed by a corps of Assistant Attorneys General and law clerks Whose character, ability, experience and training are above question, the Office of the Attorney General also continued its drives against Communism, crime and corruption, took action against fake charities, established a Division Of Charitable Trusts within the department and carried out a successful campaign of ridding the State of Obscene literature. In August of 1953, the Attorney General of the Commonwealth was elected vice-president and one Of Six members Of the Executive Board of the National Association of Attorneys General, and was also named Chairman of the Eastern States Conference Of Attorneys General, a terri tory which includes Maine, New Hampshire, Vermont, Rhode Island, Connecticut, Massachusetts, New York, New Jersey, Pennsylvania, Dela ware, West Virginia, the Virgin Islands and Puerto Rico. In October, 1953, he was appointed a member of the Committee on Narcotic Drug Control of the National Association of Attorneys General, which prepared a bill for introduction into the next session of Congress providing for the reception of narcotic drug addicts in appropriate Federal hospitals upon commitment thereto by the courts. Book excerpt: Excerpt from Annual Report of the Attorney General of the United States, 1895 I believe the new methods have proved most beneficial. The Department has been enabled to maintain a more careful watchfulness over expenditures in many directions than ever before, and to gain more accurate knowledge as to the necessity for disbursements from the various appropriations under its supervision. Under the system now inaugurated, accounts receive careful and thorough examination before they are transmitted to the Treasury, opportunity has been given for instruction of those presenting them relative to their rendition, and many irregularities have been corrected. The act requires that quarterly accounts shall be sent to the Department within twenty days after the period to which they relate, and shall be transmitted to the Treasury within sixty days of their actual receipt by the Department. In case of delay on the part of the official in sending forward his account the requirement may be waived by the Secretary of the Treasury when it is made to appear that there is a manifest physical difficulty in complying with the same. Should the Department fail to examine and transmit the accounts to the Treasury within the sixty days allowed, an order of the President is necessary to authorize an advance of money on requisitions therefor. It has been found that these requirements sometimes work hardship and result in considerable annoyance. It often happens that marshals are unable to forward their quarterly accounts within the prescribed limit of twenty days for the reason, among others, that it is impossible for them to secure returns from all of their deputies, who may be scattered over an entire district. The time for filing such accounts should be extended to forty days. This, it is believed, would cover the cases mentioned and make the new system work smoothly. It has also been found impracticable to transmit all accounts to the Treasury within the sixty days prescribed by said act. This applies especially to the accounts under the appropriation for fees and expenses of marshals. It is often necessary to have 3 such accounts corrected and charges therein explained before the Department can properly examine them, and to effect this correspondence is required between the Department and the marshal, and between the marshal and his deputies scattered over the district, which can not be completed so as to pass upon the accounts within sixty days. The limit should be increased to ninety days, if not wholly removed. Should it be deemed inexpedient to remove it, however, the act should at least be amended so as clearly to provide that in case the accounts of marshals, for unavoidable causes, are not transmitted by this Department to the Treasury within the prescribed limit, their requisitions for funds may be honored as soon as the accounts are actually received at the Treasury. Under the present law, if an account is delayed beyond the sixty days it results as a bar to the advancement of funds on pending requisitions, and the situation is not relieved by the subsequent transmission of the account, but an order from the President is required.
