Book Immigration Detention and Human Rights

Download or read book Immigration Detention and Human Rights written by Galina Cornelisse and published by BRILL. This book was released on 2010-03-08 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: Practices of immigration detention are largely resistant to conventional forms of legal correction because contemporary liberal democracies justify these practices with an appeal to their territorial sovereignty, a concept that thwarts the very communicability of individual interests in modern constitutionalism. However, this book argues that human rights in the specific context of immigration detention can function as “destabilisation rights”, subjecting to full legal scrutiny those claims that the national state presents as predominantly based on its territorial sovereignty. The resulting destabilisation of territorial sovereignty in both domestic and international constitutionalism will have ramifications for a number of instruments of migration control, the perceived necessity and legitimacy of which is almost exclusively based on the self-referential notion of territorial sovereignty.

Book The Presumption of Innocence in International Human Rights and Criminal Law

Download or read book The Presumption of Innocence in International Human Rights and Criminal Law written by Michelle Coleman and published by Routledge. This book was released on 2021-03-03 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive analysis of the presumption of innocence from both a practical and theoretical point of view. Throughout the book a framework for the presumption of innocence is developed. The book approaches the right to presumption of innocence from an international human rights perspective using specific examples drawn from international criminal law. The result is a framework for understanding the right that is grounded in human rights law. This framework can then be applied across different national and international systems. When applied, it can help determine when the presumption of innocence is being infringed upon, eroded, violated, and ensure that the presumption of innocence is protected. The book is an essential resource for students, academics and practitioners working in the areas of human rights, criminal law, international criminal law, and evidence. The themes also have a more general application to national jurisdictions and legal theory.

Book The Universal Declaration of Human Rights

Download or read book The Universal Declaration of Human Rights written by Gudmundur Alfredsson and published by Martinus Nijhoff Publishers. This book was released on 2023-06-26 with total page 818 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume celebrates the 50th anniversary of the Universal Declaration of Human Rights (UDHR). In so doing, it offers a comprehensive and systematic treatment of the rights and duties contained in the UDHR, in the light of its history, the intentions of its drafters ant the standard-setting activities and monitoring efforts which have grown out of its existence. Each article of the UDHR is treated in a separate chapter; each chapter is written by different authors, all scholars from or associated with the Nordic countries, all active in human rights work, either academically or in the field. A consolidated bibliography completes the collection. The subtitle of this volume is "A Common Standard of Achievement", a phrase drawn from the Preamble of the UDHR. In many ways, this collection is intended to demonstrate that this phrase has, to a considerable extent, come true.

Book History Historians and the Immigration Debate

Download or read book History Historians and the Immigration Debate written by Eureka Henrich and published by Springer. This book was released on 2018-10-13 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a response to the binary thinking and misuse of history that characterize contemporary immigration debates. Subverting the traditional injunction directed at migrants to ‘go back to where they came from’, it highlights the importance of the past to contemporary discussions around migration. It argues that historians have a significant contribution to make in this respect and shows how this can be done with chapters from scholars in, Asia, Europe, Australasia and North America. Through their work on global, transnational and national histories of migration, an alternative view emerges – one that complicates our understanding of 21st-century migration and reasserts movement as a central dimension of the human condition. History, Historians and the Immigration Debate makes the case for historians to assert themselves more confidently as expert commentators, offering a reflection on how we write migration history today and the forms it might take in the future.
