This book was released on 2024-02-12 with total page 393 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book conducts the first ever comprehensive study of the ICRC’s interpretations and law-ascertainments. It analyses in detail their impact on the development of international humanitarian law and international law in general as well as the reasons for their impact. This analysis involves the discussion of the ICRC’s authority. Is it legal or just factual authority? The analysis also illuminates the direction that IHL – and international law in general – develops. Book Status of NGOs in International Humanitarian Law

Download or read book Status of NGOs in International Humanitarian Law written by Claudie Barrat and published by Martinus Nijhoff Publishers. This book was released on 2014-07-24 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Status of NGOs in International Humanitarian Law, Claudie Barrat examines the legal framework applicable to NGOs in situations of armed conflict. The author convincingly demonstrates, contrary to convention, that in addition to the ICRC, the National Societies and the IFRC, numerous other NGOs referenced in humanitarian law treaties have a legal status in IHL and therefore legitimate claim to employ IHL provisions to respond to current challenges. On the basis of clear and thorough definitions of these entities, Barrat argues that existing NGOs meeting stringent definition can benefit from customary rights and obligations in both international and non-international armed conflict.

Book Commentary on the Second Geneva Convention

Download or read book Commentary on the Second Geneva Convention written by and published by Cambridge University Press. This book was released on 2017-12-21 with total page 1356 pages. Available in PDF, EPUB and Kindle. Book excerpt: The application and interpretation of the four Geneva Conventions of 1949 have developed significantly in the sixty years since the International Committee of the Red Cross (ICRC) first published its Commentaries on these important humanitarian treaties. To promote a better understanding of, and respect for, this body of law, the ICRC commissioned a comprehensive update of its original Commentaries, of which this is the second volume. Its preparation was coordinated by Jean-Marie Henckaerts, ICRC legal adviser and head of the project to update the Commentaries. The Second Convention is a key text of international humanitarian law. It contains the essential rules on the protection of the wounded, sick and shipwrecked at sea, those assigned to their care, and the vessels used for their treatment and evacuation. This article-by-article Commentary takes into account developments in the law and practice to provide up-to-date interpretations of the Convention. The new Commentary has been reviewed by humanitarian-law practitioners and academics from around the world, including naval experts. It is an essential tool for anyone working or studying within this field.

Book Prosecuting Juvenile Piracy Suspects

Download or read book Prosecuting Juvenile Piracy Suspects written by Milena Sterio and published by Routledge. This book was released on 2017-08-14 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Duncan Gaswaga, a former judge of the Seychelles Supreme Court who has presided over numerous piracy trials, asked the following question: "What is a judge to do when a bearded piracy suspect facing justice asserts that he is fourteen?" This book addresses this important question by focusing on the treatment of juvenile piracy suspects under international law within national prosecutorial regimes. Beginning with the modern-day Somali piracy model, and exploring the reasons for piracy organizers and financiers to have employed Somali youth as pirates, author Milena Sterio analyzes the relevant international legal framework applicable to the treatment of juvenile criminal suspects, such as international human rights law, international criminal law, including the statutes of several international and ad hoc tribunals, as well as legal issues related to the use of child soldiers, as a parallel to the use of child pirates. This volume examines recent national piracy prosecutions involving juvenile suspects in Germany, Spain, India, Italy, Malaysia, the Seychelles, and the United States, developing a set of recommendations and best practices for all piracy prosecuting nations dealing with juvenile suspects to refer to in developing their national policy toward the treatment of juvenile piracy suspects.

Book Socio Economic Impacts of Landmines in Southern Kurdistan

Download or read book Socio Economic Impacts of Landmines in Southern Kurdistan written by Almas Heshmati and published by Cambridge Scholars Publishing. This book was released on 2012-12-19 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Kurdistan Region of Iraq has been massively contaminated by landmines and unexploded ordnance. This will continue to be a major obstacle for development and economic growth, particularly in the rural border communities. The mines were used systematically by the central Baathist government in its efforts to de-populate the Kurdistan Region and to weaken the Kurds’ demands for regional self-determination. This work investigates the magnitude of the landmine problem in the region, and the landmine action activities undertaken to rehabilitate, reconstruct, and develop the region. In addition to that, this work emphasizes the social, health, educational and economic impacts of landmines, as well as the legal consequences. In order to achieve the abovementioned objectives, this work is divided into fifteen chapters. After providing an introduction and background to the landmine problem, the authors discuss the scope of the problem, both in the Kurdistan Region and internationally. The methods of dealing with mines and their consequences are reviewed. The issues of landmine action, impact surveys, factors influencing the survey process, and mine actions activities are also discussed. A comprehensive review of the outcome of the problem of landmines in the Kurdistan Region has been conducted. The nature and characteristics of the problems faced by Kurds are discussed in more detailed form by looking at case studies. Here the economic, social, and health impacts of landmines in the region are assessed. The issues of the human, security, and political impacts of landmines are further addressed, followed by an assessment of mine action resources and its progress, education, and various preventive measures. Finally, a number of policy recommendations are provided to prevent the use of mines in the future, and to take legal action against landmine users for clearance, rehabilitation, and compensation issues.

Book Organizational Perspectives on Environmental Migration

Download or read book Organizational Perspectives on Environmental Migration written by Kerstin Rosenow-Williams and published by Routledge. This book was released on 2015-10-16 with total page 233 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past decade, international organizations (IOs) and non-governmental organizations (NGOs) have increasingly focused their efforts on the plight of environmental migrants in both industrialized and developing countries. However, to date very few studies have analysed the influence and rhetoric of advocacy groups in the debates on environmental migration. Organizational Perspectives on Environmental Migration fills this lacuna by drawing together and examining the related themes of climate change and environmental degradation, migration and organizational studies to provide a fresh perspective on their increasing relevance. In order to assess the role of IOs and NGOs in the environmental migration discourse and to understand their interaction and their ways of addressing the topic, the book contains a wide-range of contributions covering the perspectives of organizational sociologists, political scientists, anthropologists, geographers, lawyers and practitioners. The chapters are organized thematically around the perspectives of key actors in the area of environmental migration, including IOs, courts and advocacy groups. The geographically diverse and interdisciplinary range of contributions makes this volume an essential foundational text for organizational responses to environmental migration. This volume will be of great interest to students and scholars of migration studies, international relations, organizational sociology, refugee law and policy, and development studies.
