The paper develops an index of regulatory governance and estimates its impact on sector performance, showing that indeed regulation and its governance matter. The authors use two unique databases: (i) the World Bank Performance Database, which contains detailed annual data for 250 private and public electricity companies in Latin America and the Caribbean; and (ii) the Electricity Regulatory Governance Database, which contains data on several aspects of the governance of electricity agencies in the region. The authors run different models to explain the impacts of change in ownership and different characteristics of the regulatory agency on the performance of the utilities. The results suggest that the mere existence of a regulatory agency, regardless of the utilities' ownership, has a significant impact on performance. Furthermore, after controlling for the existence of a regulatory agency, the ownership dummies are still significant and with the expected signs. The authors propose an experience measure in order to identify the gradual impact of the regulatory agency on utility performance. The results confirm this hypothesis. In addition, the paper explores two different measures of governance, an aggregate measure of regulatory governance, and an index based on principal components, including autonomy, transparency, and accountability. The findings show that the governance of regulatory agencies matters and has significant effects on performance.

Book excerpt: The aim of this paper is to empirically explore the relationship between the quality of political institutions and the performance of regulation, an issue that has recently occupied much of the policy debate on the effectiveness of infrastructure industry reforms. Taking the view that political accountability is a key factor that links political structures and regulatory processes, the authors investigate, for the case of telecommunications, its impact on the performance of regulation in two time-series-cross-sectional data sets on 29 developing countries and 23 industrial countries covering the period 1985-99. In addition to confirming some well documented results on the positive role of regulatory governance in infrastructure industries, the authors provide empirical evidence on the impact of the quality of political institutions and their modes of functioning on regulatory performance. The analysis of the data sets shows that the (positive) effect of political accountability on the performance of regulation is stronger in developing countries. An important policy implication of this finding is that future reforms in these countries should give due attention to the development of politically accountable systems.

Developing countries struggle to maintain high standards in public services such as water, energy, telecommunications, transportation, health, education, and, therefore, the adoption of policies to increase the effectiveness are needed. Privatization in theory should help these entities to become more efficient and benefit the majority of the population though, in practice, these objectives are rarely accomplished. The role of competition and regulation in such businesses are essential for development and growth, especially through the injection of private capital and fostering of competition. The principal common factor of these businesses is the natural component of monopolies which, according to Hellwig (2008), represents the use of a fixed network infrastructure that translates into largely sunk costs. Federal reforms aim for the improvement of performance in such important sectors of public services; however much of the research proves that; this has been reasonably unsuccessful in developing countries based on lack of institutional capacity. Even in theory, regulatory framework imported from developed countries was not suitable to the social and economic context in developing countries consequently the application of such previous experiences was not productive. This paper attempts to show that competition and regulation in the privatization process within developing countries could be successful if necessary reforms are based on the country’s economic, social, and political structure. As mentioned, the privatization process, as successfully applied in developed countries, requires significant adjustment for it to be pursued in transitional economies. This paper has been divided into five sections. The first section focuses on the concepts of privatization, competition and regulation. The second analyses how the role of RIA (Regulatory Impact Assessment) could increase privatization efficiency. On the other hand, the third analyses some system utilities and privatization reforms; then how competition could improve the business on privatization. The fourth section provides the control legal framework for businesses to follow. The paper concludes with recommendations and a brief summary and critique of the findings.

It is about understanding how and to what extent the effect of such elements result in significant changes in the performance of infrastructure service provision. This report focuses on the distribution segment of basic infrastructure services. It covers electricity distribution, water distribution and sewerage, and fixed telecommunications. More specifically, the report does: i) depict sector performance with a broad set of indicators that describes the current situation as well its evolution during the last 15 years; ii) propose analytical frameworks for themes less developed in the literature such as regulatory governance and corporate governance for state-owned enterprises (SOEs); iii) benchmark the institutional designs of the regulatory agencies in the region for the water and electricity sectors; and iv) analyze the relationship between sector performance and regulation, private sector participation, and corporate governance.

In section 3 we discuss regulatory commitment and its implications for regulatory governance as well as the potential role of concession contracts for regulatory commitment. Section 4 provides an exposition of regulatory governance its implications for institutional design and regulatory processes and practices and the concepts of formal and informal accountability. Ftom this discussion we derive our six criteria for appraising regulatory systems. Section 5 concludes the paper with an application of these appraisal criteria to 12 infrastructure industries in developing Asian economies. We report the main results and discuss trens including trends towards convergence of regulatory frameworks and the implications for private investment in Asian developing countries' infrasture.

This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justice system. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated.
